A petition by Paul Lucht to consider a rezone from an Agriculture Zoning District to a Commercial Zoning District and a conditional use permit pursuant to s. 7.039(7)(d) for a retail establishment, outdoor and s. 7.040(3)(d) for a wood fabrication business. Land Resources and Environment (LRE) Committee members present: M. Krueger, D. Polivka, R. Spencer, L. McAuliffe, R. Puttkamer, P. Kinsman
Others present: L. Wilson, W. Christensen, J. Alt, P. Peterson, B. Simmert. M. Schlupp
Absent: Krueger let the record know that L. Eberl and B. Lohr are excused from today’s meeting.
At 9:00 a.m. Krueger called the Land Resources and Environment Committee meeting to order and certified the meeting to be in compliance with Open Meetings Law.
Adopt agenda: Motion by McAuliffe/Puttkamer to adopt the September 27, 2022 agenda. Motion carried, all in favor.
Adopt minutes of previous meetings – September 8, 2022, and September 16, 2022. Motion by Spencer/McAuliffe to approve the September 8, 2022 and September 16, 2022 LRE Committee meeting minutes. Motion carried, all in favor.
Public Comment: No public comment.
Communications:
- Bluffview Community Park Grand Opening to be held on Saturday, October 8, 2022 at 1:00 p.m.
- Sauk County Farm Cover Crop Field Day to be held on Friday, October 7, 2022.
- Land & Water Field Day – Stream Site Assessment, Sauk County Farm to be held on Thursday, October 6, 2022.
Land Resources and Environment
- Review and approval of vouchers. Wilson presented the vouchers. Motion by Polivka/Kinsman to approve vouchers in the amount of $7,759.18. Motion carried, unanimously.
- Discussion and possible action to reschedule the Conservation Tour from 9/30/2022 to 10/14/2022. Krueger noted scheduling conflicts with LRE Committee members. Motion by Kinsman/Spencer to reschedule the Conservation Tour to 10/14/2022. Motion carried, unanimously.
Discussion and possible action on 2023 Wildlife Damage Program Budget, 2022 Crop Price Establishment, and 2022 90% Harvest date – Phil Peterson
Peterson presented the 2023 Wildlife Damage Budget of $18,061.22. The budget recognizes a 60% increase in participating farms due to increasing deer and bear populations. The budget also takes into account a cost of living adjustment, increased fuel costs, technology charges, and larger farm input costs. Motion by Puttkamer/McAuliffe to approve the 2023 Wildlife Damage Budget in the amount of $18,061.22. Motion carried, unanimously.
Peterson spoke about the deer donation program. Motion by Polivka/Puttkamer to allow Sauk County to participate in the 2023 deer donation program. Motion carried, unanimously.
Peterson presented the 2022 crop price compensation. Motion by Kinsman/McAuliffe to approve $6.25/bushel and $4.25/bushel soybeans. Motion carried, unanimously.
Peterson presented on the 2022 90% crop harvest date. Motion by Puttkamer/Polivka to set 90% harvest date at December 1st, 2022. Motion carried, unanimously.
Discussion and possible action on a Resolution Authorizing the Director of Land Resources and Environment to Submit a Grant Application for Surface Water Grant Program
Wilson explained that the Upper Sugar River Watershed Association would do work on behalf of Sauk County. Motion by Kinsman/McAuliffe to approve authorizing the Director of Land Resources and Environment to submit a grant application for Surface Water Grant Program. Motion carried, unanimously.

Krueger called the public hearing to order at 9:21 a.m.

Christensen appeared and presented the staff report, background and history.
Polivka asked for clarification regarding the town’s recommendation of approval. Christenson responded.
Eli Yoder, applicant appeared in favor.
Samuel Yoder registered in favor but did not wish to appear.
Randy Sabater spoke as interest in appear and asked about gas engines running machines and associated noise level and hours of operation.
Eli Yoder explained methods to reduce or eliminate noise.
Spencer asked about the septic system and well for a possible future home. Yoder explained that a future home may be built on the site.
Motion by Polivka/Spencer to approve a conditional use permit pursuant to s. 7.040(3)(i) wood fabrication business based on the findings of fact and conclusion of law, subject to the staff analysis, recommended conditions in the staff report and verification that the use has been approved by the Town of Woodland. Motion carried, unanimously.

A petition by Paul Lucht to consider a rezone from an Agriculture Zoning District to a Commercial Zoning District and a conditional use permit pursuant to s. 7.039(7)(d) for a retail establishment, outdoor and s. 7.040(3)(d) for a wood fabrication business. Lands affected by the proposed conditional use request are locate in the SW ¼, NW ¼, Section 2, T13N, R3E, Town of LaValle, Sauk County. Tax parcel identification number 024-0041-10000.
Christensen appeared and present the staff report, background and history.
Christensen submitted an email from Adela Felick regarding a request to utilize the same driveway.
Paul Lucht spoke in favor of the request to approve a conditional use permit for a wood fabrication business.
Polivka asked if there is a written agreement for the shared driveway. Lucht explained that there is no written agreement for the shared driveway.
Motion by Kinsman/Spencer to approve a conditional use permit pursuant to s. 7.040(3)(i) wood fabrication business based on the findings of fact and conclusion of law, subject to the staff analysis and recommended conditions in the staff report.
Motion by Kinsman/Spencer to deny the rezone request from and Agriculture Zoning District to a Commercial Zoning District and a conditional use permit pursuant to s. 7.039(7)(d) retail establishment, outdoor based on the findings of fact and conclusion of law, subject to the staff analysis and recommended conditions in the staff report. Motion carried, unanimously.
Discussion on a Revenue and Enforcement Agreement with the Towns of Woodland and LaValle Regarding Park Entrance Fees for Boat Landings
Alt explained the revenue and enforcement arrangement between Sauk County and the Towns of LaValle and Woodland and the need to transition from a percent revenue to an annual rate of $9,500.00 for the Town of LaValle $850.00 for the Town of Woodland.
Motion by Kinsman/Polivka to approve a revenue and enforcement agreement between Sauk County Land Resources and Environment and the Town of LaValle and Town of Woodland. Motion carried, unanimously.
