6. Public hearing: To begin at approximately 9:15 a.m. (Committee to consider and take possible action at the conclusion of the respective hearing.)
a. Discussion and possible action on petition #1-2016, granting of a Conditional Use Permit (CUP) pursuant to s.7.040(3) to authorize the location and operation of a metal fabrication business. This property is located in the Agriculture zoning district, in Section 26, T13N, R2E, Town of Woodland, owned by Harvey Schmucker.
b. Discussion and possible action on petition #2-2016, granting of a Conditional Use Permit (CUP) pursuant to s.7.038(9) to authorize the location and operation of a proposed wireless internet tower. This property is located in an Exclusive Agriculture zoning district, in Section 16, T10N, R6E, Town of Sumpter, owned by Melvin & Doris Lohr.
7. Discussion and possible action on the appointment of John Dietz as the Conservation, Planning and Zoning Committee Representative with Southwest Badger.
8. Discussion and possible action on FPP participant(s) appeals on notice of non-compliance issued by the Department.
9. Discussion on the maintenance of the Plain-Honey Creek Dams #2, #3, and #4 commonly referred to as White Mound, Shanahan's Pond, and the Highway N dry dam.

Conservation, Planning, and Zoning (CPZ) Committee members present: J. Ashford, D. Polivka, J. Fish, J. Dietz, E. Peterson, C. Lehman, S. Laubscher.
Excused absence: N. Johnson, C. Lehman.

At 9:00 a.m. Chair Ashford called the Conservation, Planning, and Zoning Committee meeting to order and certified to be in compliance with the Open Meetings Law.
Adopt agenda: Chair Ashford stated there is a request to move item 10 up in front of the public hearing. Motion by D. Polivka/J. Fish to adopt the agenda as amended. Motion carried, all in favor.
Adopt minutes of previous meetings with the corrections with Laubscher as no absent– Motion by D. Polivka/E. Peterson to approve the January 14th CPZ Committee meeting minutes with correction. Motion carried, all in favor.
Public Comment: No Comments.
Communications: Cunningham provided an update on the follow up on Dutch Hollow Lake violations.
Discussion and possible action on providing a portion of the funding for the creation of the Baraboo River Corridor Plan. Cunningham spoke of a meeting between Krueger, Michalek, Dave Dahlke, Village of West Baraboo President, and himself regarding the plan and the request for a $5,500 match to West Baraboo for the Plan. Michalek spoke of Phase I being completed it would be turned over to the County to complete Phase II. Ashford asked where the money will come from. Michalek stated the money will come from the Conservation, Planning and Zoning Engineering budget. Krueger spoke of supporting Phase I and Phase II becoming a placemaking tool. Polivka spoke of his reasons for supporting the expenditure. Motion by E. Peterson/D. Polivka to approve the expenditure of $5,500 for Phase I of the planning process for the creation of the Baraboo River Corridor Plan. Motion carried, all in favor.
Public Hearing: To begin at approximately 9:15 a.m. (Committee to consider and take possible action at the conclusion of the respective hearing.)
Mr. Schmucker was delayed by the weather and his public hearing was taken as the second hearing to be heard. Petition #2-2016 was heard first.
b. Discussion and possible action on petition #2-2016, granting of a Conditional Use Permit (CUP) pursuant to s.7.038(9) to authorize the location and operation of a proposed wireless internet tower. This property is located in an Exclusive Agriculture zoning district, in Section 16, T10N, R6E, Town of Sumpter, owned by Melvin & Doris Lohr.
Dave Lorenz appeared and provided the background and history of the request. He also reviewed the standards for the CUP to be approved, reviewed the photographs of the site, and any county conditions associated with the conditional use permit.
Ken Franzen, Cloud 1 LLC, applicant, appearing in favor of the request, gave details of the property and the proposed tower project. He stated they are leasing 100x100 and fencing off 50x50, which is normal for all their sites.
Peterson asked if the tower would be on the 64 acre site. Franzen confirmed.
Seeing as no one wished to speak on the hearing, Chair Ashford closed the public portion of the hearing at 9:22 a.m.
Motion by D. Polivka/J. Dietz to approve the Conditional Use Permit (CUP) to authorize the location and operation of a proposed wireless internet tower located in an Exclusive Agriculture zoning district, along with the conditions listed by the County. Motion carried, all in favor.

Dave Lorenz appeared and provided the background and history of the request. He also reviewed the standards for the CUP to be approved, reviewed the photographs of the site, and any county conditions associated with the conditional use permit. He also stated the Town of Woodland has not provided any input.
Ashford asked if they are already processing and in business. Lorenz referred the question to Sorenson.
Laubscher asked if they would continue farming. Lorenz stated he understands they will be.
Steve Sorenson appeared and stated he was at the Town Board meeting and they approved his request last month. He did state that this came in as an initial violation and has been operating the business for the last year.
Fish asked about the sawmill. Sorenson stated this business replaces the sawmill.
Peterson asked if they could still do the sawmill. Sorenson stated he believes the sawmill is gone.
Harvey Schmucker, applicant, stated they have changed the sawmill business to the metal business for roofing and siding, however there is still a planer in the building,, however they have no intention to do the sawmill at the present time. It is a family operation. He also stated he spoke to some of his neighbors and they didn’t have a problem with the use.
Seeing as no one wished to speak on the hearing, Chair Ashford closed the public portion of the hearing at 9:53 a.m.
Motion by D. Polivka/E. Peterson to approve the Conditional Use Permit (CUP) to authorize the location and operation of a metal fabrication business located in an Agricultural zoning district, along with the conditions listed by the County. Motion carried, all in favor.
Discussion and possible action on the appointment of John Dietz as the Conservation, Planning and Zoning Committee Representative with Southwest Badger. Motion by D. Polivka/J. Fish to appoint John Dietz as the Conservation, Planning and Zoning Committee Representative with Southwest Badger. Motion carried, all in favor.
Discussion and possible action on FPP participant(s) appeals on notice of non-compliance issued by the Department. Cunningham reviewed the process and spoke of the notices that were sent by the Department with the option to appear in front of committee to appeal. Sadler provided a brief update on the notices.
Discussion on the maintenance of the Plain-Honey Creek Dams #2, #3, and #4 commonly referred to as White Mound, Shanahan’s Pond, and the Highway N dry dam. Bergstrom spoke of the status of the existing dams, updates needed and costs estimates, as well as required maintenance.
Next meetings of the Conservation, Planning, and Zoning Committee will be held on Thursday, February 11, 2015 at 9:00 a.m. and Thursday, February 23, 2016 at 9:00 a.m. Motion by D. Polivka/J. Dietz to adjourn at 9:58 a.m. Motion carried all members in favor.
