FORMS:

All probate forms are available via the internet at Wisconsin Circuit Courts at www.wicourts.gov or may be obtained at cost from the Office of the Register in Probate.

HAS AN ORIGINAL WILL BEEN FILED WITH PROBATE OFFICE?:

  1. Check the CCAP case information on the internet at www.wicourts.gov
  2. Call the Probate Office at (608) 355-3226

SCHEDULING:

Walk-ins are always welcome.  We do encourage you to schedule an appointment, when possible, 24-48 hours prior to allow adequate time to address your specific inquiries.

FEES

If you require a packet of forms, there is a $10.00 charge, regardless of the type of proceeding.  However, the forms fee is due when forms are picked up or prior to mailing. $3.00 -File a claim - statutory Certified copies - $1.00 each page copied or compared, plus $3.00 for each certificate – statutory Inventory Filing Fee - .2% of total assets subject to administration or a minimum of $20. (Sec. 814.66, Wis. Stats.) - $20.00 statutory fee to file objection to Will/Personal Representative.

UNCONTESTED WILLS

The Sauk County Circuit Court Judges will admit uncontested wills, as provided by Sec. 853.03, 853.05, and 853.11(2), Wis. Stats., if those statutes are complied with. Please complete the proper forms.

CERTIFIED COPIES

Call (608) 355-3226 to request certified copies. Payment must be made before issuance of certified copies--no credit will be extended.  See fees above.
CLAIMS: Claims that have been filed against an estate may be checked at:

  1. Circuit Court Access Website (see link below)
  2. If you have the probate case number, call (608) 355-3226. If you do not have the case number you must make your request in writing accompanied by a $4.00 search fee.
  3. Claims may be accepted until closure of an estate, however, can be objected to by the Personal Representative following the Final Date to File Claims.  Copies of claims are available at the office or by written request.  There is a $1.00 per page copy fee.

TO FILE A CLAIM AGAINST AN ESTATE:

Complete Standard State Form PR-1819 and file with the Register in Probate along with the statutory filing fee  of $3.00.

TERMINATION OF LIFE ESTATE AND TERMINATION OF JOINT TENANCY:

If a deceased person had a life estate in real property that now needs to be terminated or had ownership of real estate as joint tenant, please obtain the proper forms  from the Sauk County Register of Deeds to clear and change the title.
