a. Petition #7-2012. A Petition by Daniel and Donna Meise to change the zoning of their property from a Resource Conservancy 35 to a Recreational-Commercial . The land to be affected by the proposed rezone to Recreational-Commercial is located in Section 15, T11N, R6E, Town of Baraboo. Said area to be rezoned contains 34.77 acres more or less.
7. Discussion and possible action on a conditional use permit for a 3-acre more or less Planned Unit
Development-Cluster Lot S7, T.12N.R.4E, Town of Reedsburg, Sauk County by Kevin & Vicky Rummel in
accordance with the provisions contained in Section 7.12 of the Sauk County Code of Ordinances.

Public Hearing: Petition #7-2012. A Petition by Daniel and Donna Meise to change the zoning of their property from a Resource Conservancy 35 to a Recreational-Commercial. The land to be affected by the proposed rezone to Recreational-Commercial is located in Section 15, T11N, R6E, Town of Baraboo. Said area to be rezoned contains 34.77 acres more or less.
Ashford called the public hearing to order at approximately 8:33 a.m. She explained the procedures for the public hearing and the committee and staff members were introduced.
Simmert appeared and presented a staff report. The proposed rezone will bring into compliance a relocated and expanded campground, allow for possible expansion, location of two single family homes on the same parcel, and possible future sale of items not produced on the premises. The pond is a dammed waterway. The applicant had to remove an existing house, and the campground will be affected to some extent by the new highway. There will be a frontage to the property.
Ed Lilla, with Jewell Associates in Spring Green, registered and appearing as interest may appear. We have been contracted to facilitate the next step in Meise’s campground expansion, reconstructing the existing driveway, and we will be bypassing drainage around the pond in order to return it to a more natural state and reduce the burden of the dam.
Donna Meise, applicant. We do adult foster care and have people with special needs live with us. Our two sons do the same. Seasonal trailers will stay where they are at. We are expanding the tent area and moving them. Our sons want to build another house out there. In the future, we may expand and purchase neighboring property. The new house proposed in the future is for that program to continue and build and sell things from the people living there. Driveway is 12’ wide and needs to be bigger for emergency vehicle access. The water needs to be diverted. We have been helping organizations and individuals. In lieu of cash funds they work on the land. The rule is to respect and take care of the land. We are not a nonprofit. We will have to go to the Board of Adjustment on May 24.
Steve Cahoon, Town of Baraboo Supervisor, registering as interest may appear. Donna has been working on this for a number of years. This year they came back with a stormwater plan. Our engineer made sure it was correct. The plan has been submitted to the state. The town thinks it is a good deal.
Vera Scoles, registering and appearing as interest may appear. I am speaking as a person of interest because this is going to set a precedent if you grant rezoning from ag to commercial. I would like to go commercial. I got a certified survey map, three lots will be for sale, and one will be my residence, depends on what the DOT does. If I keep the property, I will put signs and look for someone to commercialize it.
Jerome Thiessen, registering as interest may appear. There is quite a bit of water that runs there that comes from Vera’s property. That wooded area in back of those three lots is a deep valley, probably a creek about 5’ wide that goes into Meise’s pond. They want to divert the water around the pond and that makes sense.
Seeing no one else wished to appear, Lehman closed the public hearing portion at 9:09 a.m.
Simmert noted why Recreational-Commercial is the correct rezone and that the adult home is allowed the way statutes are written. They will need a special exemption permit through the Board of Adjustment.
Donna Meise, added that this is not a normal campground. It is family orientated. It is not about the money, a barter system is used for payments. We are in negotiations to buy Vera’s property and want to protect it.
Motion by Ashford/Halfen to approve the rezone request. Motion carried, all in favor.
Adopt agenda: Motion by Halfen/Ashford to adopt the agenda. Motion carried, all in favor.
Adopt minutes of previous meeting: Motion by Ashford/Halfen to adopt the minutes of the March 27 meeting. Motion carried, all members in favor.

Discussion and possible action on a conditional use permit for a 3-acre more or less Planned Unit Development-Cluster Lot S7, T.12N.R.4E, Town of Reedsburg, Sauk County by Kevin & Vicky Rummel in accordance with the provisions contained in Section 7.12 of the Sauk County Code of Ordinances:
A revised Section V-Conditions of the Conditional Use Permit was provided to the Committee. In working through this application we noted there is a shed on the property to the northern side of the house, the shed was built too close to the lot line. To the east of the property, there is an existing farm and farmstead. Consider granting a reduction under the planned unit development, provided it does not border agricultural land. Have done this once before for Dick Nolden. The Town of Reedsburg approved this at their April 9 meeting.
Rummel went to the town board, and was told since it was an ag building, no county permit was required. That is now changing.
Lehman stated he sold the existing barn and house to his son, there is another house in there that is part of an old Ellis farm. It was built as an ag building, and he did not think it was necessary to get a building permit.
Rummel wants to create a 3-acre PUD lot in order to get a conventional loan.
Borleske informed that that town did recommend approval contingent on approval of the setback of the shed. It is true that he did get the appropriate permits when it was built. It is difficult for the towns to know when permits are necessary.
Motion by Nobs/Ashford to approve this and have the Corporation Council and Conservation, Planning, and Zoning look into a possible deletion of the penalty.
Simmert informed that we could consider as a non-confirming structure and then no permit or permit fees required.
Motion by Halfen/Nobs to amend to make it a non-confirming use for that building and remove condition No. 7. Motion carried, all in favor.
Call the question, carried-all in favor.
There was a short break, and the meeting reconvened at 9:44 a.m.
Discussion and possible action on formalizing responsibilities of the County Surveyor: Liebman noted there was a lot of debate but have come to a resolution on the ordinance. The salary will cover four office hours during the week and hourly rate fees will be for additional duties. Recommends to take action on this at the May County Board meeting.
Krueger stated that the desire was to get this done by the April County Board, but this can wait until the May meeting.
Motion by Halfen/Ashford to approve the ordinance and addendum. Motion carried, all in favor.
Surveyor Department:
a. Department Report: None.
b. Review and approval of vouchers: Motion by Halfen/Ashford to approve the February and March vouchers totaling $6,950. Motion carried, all in favor.
Motion by Halfen/Ashford to adjourn the meeting at 9:54 a.m. Motion carried with all members in favor.
