Floodplain Zoning Ordinance, to adopt official maps and supporting information that identifies lands within
the hydraulic shadow should the Lake Redstone Dam fail during a 100-year storm event and apply the
provisions of Section 9.04 Floodway District
13. Discussion of new sign ordinance and anticipated time frame for public input

possible action at the conclusion of respective hearing)
a. *Petition #6-2011 A Petition by Garry Zellmer to change the zoning of his property from a Resource
Conservancy 35 to a Commercial Zoning District. The land to be affected by the proposed rezone to
Commercial is located in Section 21, T12N, R6E, Town of Baraboo. Said area to be rezoned contains
.90 acres more or less.

Planning, Zoning, & Land Records (PZLR) Committee members present: J. Ashford, J. Gaalswyk, F. Halfen, G. Lehman, D. Nobs
Others present: A. Kleczek Bolin, A. Brylla, C. Czarnecki, J. Fish, K. Mead, B. Michalek, K. Muchow, R. Nolden, T. Novy, P. Pohle, B. Simmert, G. Zellmer, K. Zimmerman
Absent: No committee member absent.
At 9:03 a.m. Chair Lehman called the Planning, Zoning and Land Records Committee to order and certified to be in compliance with the Open Meetings Law.
Adopt agenda: Motion by Ashford/Gaalswyk to delay agenda item #6 for Petition #4-2011 to later in the agenda and remove #10-Communications. Motion carried, all in favor.
Adopt minutes of previous meeting: Motion by Ashford/Halfen to adopt the minutes of the August 23 and 30 meetings with the change that Gaalswyk was absent at the August 23 meeting. Motion carried, all members in favor. Motion carried, all in favor.
Public comment: Fish and Brylla addressed the concern of high nitrates in many of the wells in the Town of Excelsior.
Communications:
a. Letter from NRCS Hydraulic Engineer regarding Lake Redstone Dam Failure Analysis Report: Letter was provided to the Committee informing of two typographical errors in the report.
b. Letter from Attorney Molberg regarding Lawrence and Bridget Mundth’s farm consolidation: The letter requesting an appeal was provided to the Committee. Kleczek Bolin is setting up a hearing in front of an impartial party.
Approval of an ordinance effectuating Petition #4-2011 as submitted by the Town of Excelsior c/o Joe Fish, Town Chair to change the predominant zoning in the Town of Excelsior from a Resource Conservancy-5 to a Resource Conservancy-35 Zoning District. The land to be affected by the proposed rezone to Resource Conservancy-35 includes all lands currently zoned Resource Conservancy-5: The County Board sent this ordinance back to the PZLR for approval. Motion by Halfen/Gaalswyk to approve the ordinance. Motion carried, all in favor. It will now go back to the County Board for their approval.
Land Records Modernization:
a. Department report: Felton presented the report and noted that the output measures will be updated next month.
b. Review and approval of vouchers: Motion by Ashford/Halfen to approve the monthly vouchers in the amount of $52,770.10. Motion carried, all in favor.
Surveyor Department:
a. Review and approval of vouchers: Motion by Halfen/Nobs to approve vouchers in the amount of $1,100. Motion carried, all in favor.
Register of Deeds Department (ROD):
a. Department report: Bailey presented his departmental report and discussed redaction fees.
b. Review and approval of vouchers: Motion by Gaaslwyk/Ashford to approve the monthly vouchers in the amount of $2,895.32. Motion carried, all in favor.
c. Review and possible action on approving purchase of three Fujitsu scanners: Bailey stated that the three scanners were initially included in 2012 budget. Due to completion of the Mapping Department move into the ROD, Bailey would like to purchase them as soon as possible. The current scanners are from 1997 and cannot get replacement parts. The scanners are approximately $900 each; looking at an expenditure of $3,000. There is money remaining in the 2011 budget, and MIS has approved the purchase. Will not have a maintenance contract on the new Fujitsu scanners. Motion by Ashford/Gaalswyk to approve the purchase. Motion by Halfen/Ashord to amend motion to limit to no more than $3,000 total. Motion to amend motion carried. Motion as amended carried, all in favor. The 2012 budget will be adjusted for the removal of these scanners.
Discussion and possible action to amend a conditional use permit for a 3 acre more or less Planned Development-Cluster Lot to reduce side yard setback requirements in S31, T.10N.-R.6E, Town of Prairie du Sac, Sauk County by Richard & Laura Nolden in accordance with the provisions contained in Section 7.12(4)(d) of the Sauk County Code of Ordinances: Provided the front page of the Certified Survey Map (CSM); were unable to approve the CSM as presented due to the setbacks. Several options were previously presented to Noldens. One option gives this committee review and approval of conditional use permits, and they could grant a lesser setback to the Noldens. Motion by Ashford/Nobs to amend Section 5, Item 6, to read as follows: Per Sauk Co. Code Ch. 7, Section 7.12(4)(d), the applicant has been granted a side yard setback for the house of 4 feet from the easternmost property line. This setback shall be noted on the recorded Certified Survey Map. Motion carried, all in favor.
There was a five-minute recess, and the Committee reconvened in open session.
The hearing was called to order at 10:32 a.m., and the members introduced themselves.
Petition #6-2011 A Petition by Garry Zellmer to change the zoning of his property from a Resource Conservancy 35 to a Commercial Zoning District. The land to be affected by the proposed rezone to Commercial is located in Section 21, T12N, R6E, Town of Baraboo. Said area to be rezoned contains .90 acres more or less.
Simmert presented the staff report. Staff recommends that the PZLR Committee postpone action at this time because the Town of Baraboo Board has not had an opportunity to consider the rezone and they will take action on October 10.
Garry Zellmer, registered as “appearing in favor.” The rezone is necessary to put up a sign; looking at one that will be lit but not as large as Papa Bear’s sign. Looking for income to pay taxes on the approximately one-acre vacant lot. Will seek a permit for the sign, and the sign company will have control as to what is on the sign with Zellmer’s input; will be a sign for a local business.
No other public comment was received; Chair Lehman closed the public portion of the hearing at 11:00 a.m.
Motion by Gaalswyk/Nobs to postpone action until we hear the outcome from the Town of Baraboo’s meeting. Motion carried, all in favor.
Discussion and possible action on Petition #3-2011. A Petition to amend Chapter 9, the Sauk County Floodplain Zoning Ordinance, to adopt official maps and supporting information that identifies lands within the hydraulic shadow should the Lake Redstone Dam fail during a 100-year storm event and apply the provisions of Section 9.04 Floodway District: Michalek reviewed the questions from the August 30 meeting and provided the answers received.
Motion by Gaalswyk/Halfen to put on the table to approve.
Kleczek Bolin noted that DNR is aware of the problem with adoption being required by the counties but not by cities. If we want issues brought to the state level, we need work with the Wisconsin Counties Association (WCA).
Motion to amend motion by Nobs/Ashford to send to the December County Board meeting. Motion to approve amendment, all in favor.
Vote on original motion carried with Lehman and Nobs voting against.
Discussion of new sign ordinance and anticipated time frame for public input: Simmert informed the PZLR that the subchapter will supersede the ordinance. The draft ordinance will be presented to the towns within the next few weeks, presented at a public hearing at the end of November, and presented to the County Board in December. He reviewed the proposed changes and received the committee’s input.
Next meeting of the Planning, Zoning & Land Records Committee and the Land Conservation Committee will be held on Thursday, October 13, at 9:00 a.m.
Motion by Ashford/Nobs to adjourn at 12:23 p.m. Motion carried, all in favor.
