At 9:03 a.m. Chair Lehman called the Planning, Zoning and Land Records Committee to order and certified to be in compliance with the Open Meetings Law.
Chair Wiese called the Land Conservation Committee to order and certified to be in compliance with the Open Meetings Law.
Adopt agenda: Motion by Borleske/Smoke to move the agenda item regarding the letter of support for the Lake Redstone Planning Grants to communications on the agenda. Motion carried, all PZLR members in favor. Motion carried, all LCC members in favor.
Adopt minutes of previous meetings-January 12: Motion by Gaalswyk/Nobs to adopt the minutes of the meeting on January 12 of the Planning, Zoning & Land Records Committee. Motion carried, all PZLR members in favor.
Motion by Gaalswyk/Borleske to adopt the minutes of the meeting on January 12 of the Planning, Zoning & Land Records Committee and Land Conservation Committee. Motion carried, all LCC members in favor. Motion carried, all PZLR members in favor.
Public comment: L. Hasenbalg stated the she has come to the last three meetings expecting a public apology be made to her and the committees. She respects the process and had hoped we could take care of this in the appropriate manner and move forward.
Communications:
a. Wisconsin Land & Water Conservation Association (WLWCA) Newsletter-Thursday Note(s): Bergstrom highlighted the January 19 Thursday Note. There was discussion regarding the status of the drainage protection district, and it was agreed to have as a future agenda item.
b. DNR notification of proposed state land purchase for the Ice Age Trail in the Town of Greenfield: Michalek received notification of a willing seller of 51.72 acres in the Town of Greenfield to be part of the Ice Age Trail adjacent to existing state land.
c. Discussion and approval of letter of support for Lake Redstone Planning Grants: The LCC and Conservation, Planning, and Zoning Department were asked to write letters of support for the Lake Redstone Planning Grants to assist with their planning needs to protect the lake. Michalek sent one on behalf of the department. Motion by Murray/Smoke to approve the letter of support. Motion carried, all LCC members in favor.
Approval of 2011 crop damage assessment for Wildlife Damage Program participant: Phil Peterson was unable to attend the meeting but sent the paperwork to be approved for payment. There was one participant, Brad Moore, that met all the requirements for the 2011 crop damage assessment. He had bear damage to his bee hives, and his payment will be $945.16. Motion by Borleske/Smoke to approve payment of $945.16 to Brad Moore for the 2011 crop damage assessment. Motion carried, all LCC members in favor.
Discussion and possible action on a conditional use permit for a 5-acre more or less Planned Unit Development-Cluster Lot S25, T.12N.R.7E, Town of Greenfield, Sauk County by Richard Biech in accordance with the provisions contained in Section 7.12 of the Sauk County Code of Ordinances: Simmert explained that the Town of Greenfield is going through a process to review and to postpone action until this is complete. Motion by Gaalswyk/Ashford to postpone action until the Town of Greenfield takes action. Motion carried, all PZLR members in favor.
Review and possible action on ordinance amending Chapter 20, Uniform Citation Ordinance, Section 20.07(3), Chapter 7: Zoning Ordinance Pertaining to Sign Regulations: Chapter 20 needs to be updated to match the new sign ordinance that was adopted. Motion by Ashford/Gaalswyk to approve this change. Motion carried, all PZLR members in favor.
Updates and possible action on floodplain zoning ordinance/Lake Redstone Dam Breach Study: Michalek reported that there was a meeting with the following people on February 1-Todd Allbaugh, Chief of Staff from Dale Schultz’s office; Bill Sturtevant, Gary Heinrichs, Meg Galloway and Konny Margovsky, DNR; State Representative Ed Brooks; Ron Churchill, Winfield Town Chair; Marty Krueger, Kathy Schauf, Todd Liebman, Brentt Michalek, Brian Cunningham, Sauk County; Dick Fish, LaValle Planning Commission (on speakerphone). It was clarified that the City of Reedsburg can “opt out” of the high hazard dam rating but need to adopt the FEMA floodplain. It is equal to or more restrictive than the dam breach. In order to supersede the ordinance, would have to go through the committees, legislature, and then to the governor. There is no definite timeline to complete the process to supersede but estimate three-six months. The public hearing will be held locally and we will notice. There are no estimates on the costs, but we currently have a grant that we received $45,000 of the $50,000 that would need to be repaid. DNR has asked us to possibly put in place a moratorium instead of adopting the dam breach study until the FEMA floodplain maps are adopted, and then ask to have them both adopted at the same time by the end of this year. With the moratorium, people who have permits in place those permits could be honored. Any new construction would not be allowed with the moratorium. If we do not accept the dam breach, we would need to lower the water level to bring the dam from a high hazard to a low hazard dam. DNR personnel could come to the next committee meeting and also to the full County Board. Liebman is exploring some moratoriums. May bring a final draft of the moratorium to the February 28 meeting and then to the March 20 County Board meeting. The DNR is willing to meet with individuals in the affected area. The notification process for the moratorium will comply with the public hearing process.
Update on Request for Qualification (RFQ) on engineering/consulting firm: Part of the approved budget was to hire an engineering/consulting firm. The RFQ went out and a decision will be made in the near future. Expenses will be listed on the monthly vouchers. Currently there are no manure or stormwater permits applications that require an engineer.
Discussion regarding policy directions for the rewrite of Chapter 7 Sauk County Zoning Ordinance: Simmert provided a “Policy Question Sheet” asking if the county should allow and regulate accessory dwelling units. There was no desire to add this language at this time.
The other question listed was “should Sauk County regulate sexually oriented businesses (SOBs) by including and adopting a SOB subchapter in Chapter 7?” Consensus was that some language should be included.
Corporation Counsel is currently reviewing the draft ordinance.
Funding assistance for Bear Creek Habitat Improvement Project: In 2011 the LCC approved $10,000 for trout restoration on a mile section of Bear Creek. It went so well that Trout Unlimited (TU) wants to do another section. This is a partnership with TU, NRCS, DNR, and the CPZ. Motion by Smoke/Borleske to approve the $10,000 for Bear Creek. Motion carried, all LCC members in favor.
Review and approval of 2011 carryforwards: The final carryforward numbers were provided totaling $674,728.45. The 2012 budget included estimated amounts. Motion by Gaalswyk/Borleske to carry forward $674,728.45 in to 2012. Motion carried, all PZLR members in favor. Motion carried, all LCC members in favor.
Review bids and possible approval of resolution for a replacement vehicle: The three bids received for a replacement vehicle were presented to the committees. Motion by Borleske/Nobs to approve the bid from Don Larson, Inc. for $18,552 for 2012 Chevy Colorado truck and topper. Motion carried, all PZLR members in favor. Motion carried, all LCC members in favor.
Conservation, Planning, and Zoning Department:
a. Department reports and updates: Michalek reviewed the Conservation, Planning, and Zoning department report.
b. Review and approval of vouchers: Motion by Ashford/Gaalswyk to approve the 2011 and 2012 vouchers in the amount of $13,430.51. Motion carried, all PZLR members in favor. Motion carried, all LCC members in favor.
Reports:
a. Natural Resources Conservation Service (NRCS) report: The NRCS technician Tony Pillow introduced himself. His main workload is the Environmental Quality Incentives Program (EQIP).
b. Farm Serice Agency (FSA) report: Norgard announced there will be a general Conservation Reserve Program (CRP) sign up March12-April 6. Sauk County has 127 contracts expiring amounting to roughly 2,000 acres.
c. Foresters’ report: None.
d. Economic Development Committee report: Murray stated they met on January 23 and there is nothing to report on Rails to Trails. Passed the preliminary stage of the draft for the Spring Green forest. The county approved making it a county forest according to DNR rules. The committee accepted a recommendation to deal with the Hwy. 12 bypass and looking at similar discussion with stakeholders.
e. Mirror Lake District report: Smoke nothing to report.
f. Lake Virginia Management District report: Michalek reported that they may request that the county take over the district and/or the dam. There is a town road of which the dam is the foundation for the road. They are also looking at the equalized values for living on and off the lake.
g. Lake Redstone Management District report: Borleske reported they are meeting next Tuesday night.
Due to a possible quorum being present at the Highway 12 corridor meeting next week, the meeting will be posted.
Next meeting of the Planning, Zoning & Land Records Committee will be held on Tuesday, February 28, and the meeting of both the Land Conservation Committee and Planning, Zoning & Land Records Committee will be held on Thursday, March 8, at 9:00 a.m. in B24.
Motion by Gaalswyk/Ashford to adjourn at 11:28 a.m. Motion carried, all PZLR members in favor. Motion carried, all LCC members in favor.
