SMALL CLAIMS INFORMATION

• Plaintiff does not appear at the Return date. 
• The Return date is not before the Court Commissioner. 
• The Return date is an answer period for the Defendant(s). 
• The Defendant may file a written answer with the Clerk of Circuit Court (copy to Plaintiff if not an attorney or efiler) no later than the Return date.
• Answers will be accepted until 12 p.m. on the scheduled Return date.  
• Written answers must be filed by the following means:

Once the Defendant is sheriff/private process served, the certificate of service must be filed with the Clerk of Circuit Court by the Plaintiff prior to the Return date.  

If the matter is contested by the Defendant, the matter will be set for further proceedings.
