A quorum may be present consisting of members of the Aging & Disability Resource Center and Veterans Service Office Committee; Board of Health; Economic Development Committee; Executive & Legislative Committee; Extension Education, Arts & Culture Committee; Finance Committee; Health Care Center Board of Trustees; Highway Committee; Human Services Board; Land Resources and Environment Committee; Law Enforcement & Judiciary Committee; Personnel & Insurance Committee, and Property Committee. No governing body will exercise any responsibilities, authority, or duties except for the Land Resources and Environment Committee. It is possible that a quorum of County Board members will be at this meeting to gather information about a subject over which they have decision-making responsibility. This constitutes a meeting of the County Board pursuant to State ex re Badke v. Greendale Village Board, Wis 2d 553, 494 n.w.2d 408 (1993), and must be noticed as such, although the County Board will not take any formal actions at this meeting. It is also possible that there may be quorums of other County Board Committees present, although those committees will not take any formal action at this meeting.

- Petition 04-2023 - A petition to consider a conditional use permit pursuant to s7.027 (3) for agricultural tourism to expand an existing winery business on land owned by Dean and Victoria Baumgarten. Lands affected by the proposed conditional use are located the SE ¼, NE ¼, Section 7, T11N, R4E, Town of Westfield, and as further described in Petition 04-2023. Tax parcel identification number 040-0132-01000.

Land Resources and Environment (LRE) Committee members present: M. Krueger, P. Kinsman, D. Polivka, L. Eberl, R. Puttkamer, V. McAuliffe, B. Spencer
Other present: L. Wilson, M. Schlupp, R. Meyer, W. Christensen, D. Baumgarten, V. Baumgarten, L. Broughton
Absent: B. Lohr (Excused)
At 9:04 a.m. Krueger called the Land Resources and Environment Committee meeting to order. R. Meyer certified the meeting to be compliant with Open Meetings Law.
Adopt agenda - Motion by Kinsman / McAuliffe to adopt the April 25, 2023, agenda. Motion carried unanimously.
Adopt minutes of previous meetings
- April 13, 2023 - Motion by McAuliffe / Spencer to approve the April 13, 2023, LRE Committee meeting minutes. Motion carried, unanimously.
Public comment – No public comment
Communications – M. Krueger provided a letter received from Town of Delton regarding tax forfeiture property in the Township.
Land Resources and Environment
- Review and approval of vouchers. L. Wilson presented the vouchers in the amount of $38,882.81. Motion by Polivka / McAuliffe to pay vouchers in the amount of $38,882.81. Motion carried, unanimously.
- Discussion and possible action on a Resolution Authorizing the Director of Land Resources and Environment to Submit Grant Applications for DATCP Clean Sweep Grant Program and Authorization for Chair/Vice Chair to Submit a Letter of Support. L. Wilson presented the resolution authorizing the Director of Land Resources and Environment to Submit Grant Applications for DATCP Clean Sweep Grant Program and authorization for Chair/Vice Chair to submit a letter of support. Motion by Eberl / Puttkamer to approve a resolution authorizing the Director of Land Resources and Environment to submit grant applications for DATCP Clean Sweep Grant Program and to authorize for Chair / Vice Chair to submit a letter of support. Motion carried, unanimously.
- Discussion on 2023 USDA-NRCS Cooperative Conservation Agreement Grant application. L. Wilson presented the draft application for the 2023 USDA-NRCS Cooperative Conservation Agreement. Wilson noted the draft application has been presented to the Administrator, Brent Miller, and Accounting Manager, Lynn Horkan. Wilson noted that both did not find issue with the submittal of the application. Motion by Polivka / Spencer to proceed with the Grant application process. Motion carried unanimously.
Discussion and possible action on Sauk County Donation and Memorial Policy – L. Wilson presented a draft policy from Building Services and a draft policy from Land Resources and Environment of a Donation and Memorial Policy. Spencer provided some background on the rational for the policy. Krueger indicated that he would reach out to the Chair of the Property Committee and have a discussion regarding the proposal.
Public Hearing: To begin at 9:15 a.m. or as soon thereafter for the Committee to consider and take possible action at the conclusion of the respective hearing. The Public hearing began at 9:22 a.m.

R. Meyer certified that the public hearing notice for Petition 04-2023 has been properly posted. R. Meyer read the public hearing notice.
W. Christensen presented the staff report, background, and history. Christensen stated that on April 10, 2023 the Town of Westfield Town Board recommended approval of the proposed conditional use permit as well as LRE Staff.
Applicant, Dean Baumgarten, stated the reason for the conditional use permit is for a 36 x 36 shed to be used for storage of supplies for the winery and wine that needs to age. They would also like to extend hours of operation to Tuesday – Sunday from 10am – 9pm.
Victoria Baumgarten registered in favor of the conditional use permit but did not speak.
There was no public comment in opposition.
Lorinda Broughton registered and spoke as an interested party of the conditional use permit, noting that the parking lot is dark. Broughton also noted the safety concern with increase of traffic within the farming community with customers of the winery missing the entrance.
Dean Baumgarten spoke regarding Lorinda Boughton’s concerns. Dean Baumgarten stated they will put up a few solar lights in the parking lot and can work on signage or possibly put a flag at the end of the driveway when they are open.
Public hearing for Petition 04-2023 closed at 9:45 am.
Motion by Polivka / Kinsman to approve Petition 04-2023 to approve the conditional use permit as presented, based on the findings of fact and conclusion of law, subject to the staff analysis, and recommend conditions in the staff report. Motion carried, unanimously.
This concludes the public hearing portion of the meeting.
Next meeting dates –Thursday, May 11, 2023, and Tuesday, May 23, 2023 at 9:00 am
Adjournment - Motion by Spencer / Kinsman at 9:47 am. Motion carried, unanimously
