This meeting is open to the public. a. Petition 19-2021. A petition to consider a conditional use permit pursuant to s7.039(7)(d) for a retail establishment, outdoor. Said conditional use is located in the Town of Sumpter, Sauk County. At 9:00 a.m. Chair Krueger called the Land Resources and Environment Committee meeting to order and certified to be in compliance with the Open Meetings Law.
Adopt agenda: Motion by Curry/McAuliffe to adopt the agenda as presented. Motion carried, all in favor.
Adopt minutes of previous meetings – March 10, 2022: Motion by Nelson/McAuliffe to approve the March 10, 2022 LRE Committee meeting minutes. Motion carried, all in favor.
Public Comment: Steve Higgins wanted to inform everyone that Devils Lake Crossing drew up a map of the development that included 20 acres of his property for development. Higgins stated he was not approached to be involved, will not selling this property and will not annex into the City of Baraboo.
Communications: Chair Krueger stated that he had met with last week with Chair McCumber, Administrator Miller, Corp Counsel Desmond, representatives from the DNR Senator Marklein and Representative Kurtz on the Hemlock Dam. Krueger provided an update and noted that the item will be on the April 14, 2022 LRE meeting agenda.
Land Records
a. Department report – Krueger stated there is no department report.
b. Review and approval of vouchers – Felton was unable to attend meeting. Wilson provided the vouchers in the amount
of $10,080.00. Motion by McAuliffe/Curry approve the vouchers in the amount of $10,080.00. Motion carried, all in
favor.
Land Resources and Environment
a. Review and approval of vouchers – Wilson provided the vouchers in the amount of $20,005.86. Motion by
Nelson/McAuliffe to approve vouchers in the amount of $20,005.86. Motion carried, all in favor.
Public Hearing: To begin at approximately 9:15 a.m. or soon thereafter. Committee to consider and take possible action at the conclusion of the respective hearing.
Hillmann appeared and presented the background and history. Polivka asked if the property is zoned commercial and what is allowed under commercial zoning. Hillmann explained. Nelson asked what the delay was for at the August and November public hearings. Hillmann stated he did not have a complete application.
Nelson asked if Delaney is currently noncompliant. Nelson asked if the conditional use permit application is denied today does it become an enforcement issue. Hillmann stated yes.
Dennis Delaney, applicant, appeared in favor of the request. Delaney stated he received the site plan yesterday from Grothman Associates. Polivka asked the applicant if his intent is to get a conditional use permit and what has been the delay. Delaney stated the delay was getting all paperwork complete, particularly the site plan.
Robin Meier, Treasurer and Deputy Clerk for the Town of Sumpter, stated the Town had not received any additional documentation, or information to address the Town’s issues. Meier stated the Town did not have enough information to make a recommendation on this conditional use permit.
Michelle Delaney, appearing in favor, wanted to clarify they were told they needed a site map and that is what was holding them up. Delaney stated Grothman was backed up, so that is why they just received the site map yesterday. Delaney stated they thought that was all they needed.
Chair Krueger closed public hearing portion and went into deliberation at 9:40 a.m.
Nelson asked Hillmann if he was in contact with the applicant. Hillmann stated the department notified the applicant to contact the Town to address their requests and concerns. Polivka asked if the petition was denied, what could the applicant do. Hillmann explained the applicant would have the opportunity to reapply with the requested materials from the Town.
Motion by Polivka/McAuliffe to deny the conditional use permit for a retail establishment, outdoor based on the findings of fact and conclusion of law subject to the staff analysis and conditions; and the applicant can reapply for a conditional use permit when the information requested by the Town has been met. Motion unanimously approved.
b. Petition 02-2022. A petition to consider a conditional use permit pursuant to s7.027(10)(g) to operate a sawmill. Said conditional use is located in the Town of Westfield, Sauk County. Lands affected by the proposed conditional use are located in part of the SW ¼, Section 19, T11N, R4E, Town of Westfield, and as further described in Petition 02-2022. Tax parcel identification numbers 040-0414-00000, 040-0415-00000, 040-0416-00000, and 040-0417-00000.
Simmert presented the background and history.
Nelson asked about condition K, which indicates the plan needs to be approved by the state. Simmert stated that was a condition requested by the Town. Wilson stated it would probably be reviewed by the Department of Safety and Professional Services. Wilson stated the Town would probably not have a commercial reviewer on staff.
Dan Gingerich, applicant, stated that he spoke to John Muhlenberg, DSPS, on what needs to be done to get the building permit.
Chair Krueger closed public hearing portion and went into deliberation at 10:06 a.m.
Motion by Curry/Kinsman to approve a conditional use permit to operate a sawmill based on the findings of fact and conclusion of law subject to the staff analysis and conditions subject to the town conditions a well. Motion unanimously approved.
c. Petition 03-2022. A petition to consider a conditional use permit pursuant to s. 7.027(12) for the location and
operation of stable/equestrian facility on land owned by Dana and Logan Sechler/LoBar Ranch LLC, Town of Dellona,
Sauk County. Lands affected by the proposed conditional use are located in part of the NW¼ SE¼, NE ¼ SW ¼, SE ¼
NW ¼ & SW ¼ NE ¼, plat of survey 15615 Section 2, T13N, R5E, tax parcel identification number 006-0030-00000.
Templin-Steward appeared and presented the background and history. Polivka asked if the Town of Dellona is denying
this proposal. Templin-Steward stated that the Town is approving the proposal for limited activities which are included
in the staff memo.
Dana Sechler, applicant, stated he worked with the department and the Town of Dellona. Sechler stated it was everything
they hope to do with the exceptions of the cabins. Sechler stated the only issue was the driveway, but they came up with a
one-way driveway and resolved the flow of traffic. Sechler stated he is in favor of all the conditions and is ready to get
started.
Chair Krueger closed public hearing portion and went into deliberation at 10:28 a.m.
Motion by Kinsman/Curry to approve a conditional use permit to operate a stable/equestrian facility based on the findings
of fact and conclusion of law, subject to the staff analysis and recommended conditions in the staff report. Motion
unanimously approved.
d. Petition 05-2022 A petition to consider a conditional use permit pursuant to s.7.040(3)(i) for the location and operate of a wood fabrication facility. Said conditional use is located in part of the E ¼, SW ¼ and part of the W ½, SE ¼, of Section
10, T10N, R3E, Town of Bear Creek, Sauk County, tax parcel identification number 004-0562-10000.
Templin-Steward appeared and presented the background and history. Nelson questioned the wording of the Town’s
recommendations. Templin Steward provided guidance. Chair Krueger stated item 3 should read that the applicant should
work with the Highway Department to install signage. Krueger stated item 8 should read that the culvert will be reduced
from 60 to 40 feet. Templin-Steward recommended a time frame for getting the culvert work completed by the Highway
Department.
John Borntreger, applicant, in favor of the request provided comments regarding the request.
Chair Krueger closed public hearing portion and went into deliberation at 10:51 a.m.
Motion by Kinsman/McAuliffee to approve the conditional use permit for the location and operation of a wood fabrication
facility based upon the findings of fact and conclusion of law as contained in the staff report and subject to the following
conditions:
- The recommended conditions A-O.
- The addition of Item Q that the application work with the Highway Commissioner to schedule the installation of a 40-foot culvert within the next 30-days.
3. Item P to include the Towns recommended conditions, with Item 3 being that the applicant works with the Highway
Commissioner to install signage on County Road G including a school zone sign and truck entrance sign within 30
days and Item 8 being amended to reduce the required culvert width to 40 feet.
e. Petition 07-2022. A petition to consider a conditional use permit pursuant to s7.036(6)(e) for a Resort and s.7.035(3)(e)
for a Recreational Facility, Outdoor on land owned by Steve and Lynn Higgins Town of Baraboo, Sauk County. Lands
affected by the proposed conditional use are located in part of the NW ¼, NW¼, Section 13, T11N, R6E, Town of Baraboo,
SW¼, SW¼, Section 12, T11N, R6E, and NW¼, SW¼, Section 12, T11N, R6E, Tax parcel identification numbers 002-
0384-00000 and 002-0349-00000.
Hillmann appeared and presented the background and history.
Steve Higgins, applicant, in favor of the request. Nelson asked if the plan was for just the one building and if the campground was still functioning. Higgins stated it was for just the one building and the campground was still in use.
Randy Puttkamer, Town Board Supervisor and Baraboo Plan Commissioner member, stated the Town had a few concerns
when this first came forward, but everything has been resolved. Puttkamer stated that some of those concerns were the campground operation, driveway, and the sanitary system. Puttkamer explained the driveway and the sanitary sewer district items. Nelson asked if it was not feasible to connect to sewer due to the distance. Puttkamer stated it was not feasible because of the distance and the costs.
Chris Kratorhwill, appearing as interest may appear, asked if this conditional use permit was related to the Devil Lake Crossing.
Nelson asked if we are approving the 1 cabin structure, and if there were any other structures in the future would that be a new application. Simmert stated he would have to come back for any other structures.
Chair Krueger asked Higgins to come forward to answer the question of the interested party. Higgins stated that it has nothing to do with the Devils Lakes Crossing and he was not involved with that development.
Chair Krueger closed public hearing portion and went into deliberation at 11:25 a.m.
Motion by Curry/McAuliffe to approve the conditional use permit for a Resort and a Recreational Facility based on the
findings of fact and conclusion of law as contain in the staff report, and subject to the staff analysis and conditions
deleting N and O. Motion unanimously approved.
f. Petition 08-2022. A petition to consider a rezone from an Agriculture and Commercial to an Exclusive Agriculture zoning district. Said rezone use is located in the Town of Excelsior, Sauk County. Lands affected by the proposed rezone are located in part of the NE ¼, SE ¼, of Section 07, T12N, R05E, Town of Excelsior, Sauk County, Tax parcel identification number 010-0229-21000.
Hillmann appeared and presented the background and history.
Eric Larsen, applicant, in favor of the request, explained the reason for the request.

Motion by Polivka/Nelson to approve the rezone from Agriculture and Commercial to Exclusive Agriculture zoning based upon the findings of fact and conclusion of law, as noted in the staff report. Motion unanimously approved.
g. Petition 09-2022. A petition to consider a rezone from a Commercial to an Agriculture zoning district. Said rezone use is located in the Town of Baraboo, Sauk County. Lands affected by the proposed rezone are located in part of the NE ¼, SE ¼, of Section 21, T12N, R6E, Town of Baraboo, Sauk County, and as further described as Lot 1 CSM 2650, Tax parcel identification number 002-0662-00000.
Simmert appeared and presented the background and history.
Wally Czuprynko, Weichert Realtors, agent for the property owner, provided background on the request. Nelson asked if there was an identified buyer for this property. Czuprynko stated there was a buyer.
Randy Puttkamer, Town Board Supervisor and Baraboo Plan Commissioner member, stated that the septic was being addressed since it was a commercial model home vs a tourist rooming house. Puttkamer would like to complement the staff, they worked well with the township and applicant to find a suitable resolve for this. Puttkamer stated there have been other parcels that were rezoned in the area since the bypass was constructed.
Chair Krueger closed public hearing portion and went into deliberation at 11:50 a.m.
Motion by Kinsman/Polivka to approve the rezone from Commercial to an Agriculture zoning based on the findings of fact and conclusion of law as contain in the staff report staff report. Motion unanimously approved.
h. Petition 10-2022. A petition to consider a conditional use permit pursuant to s.7.027(2)(h) for the expansion of an agriculture-related business owned by A & L MC Inc. Said conditional use is located in the Town of Baraboo, Sauk County. Lands affected by the proposed conditional use are located in part of the SW ¼, NE ¼, of Section 04, T11N, R06E, Town of Baraboo, Sauk County, tax parcel identification number 002-0096-00000.
Hillmann appeared and presented the background and history.
Aaron McReynolds, applicant appearing in favor of the request, provided information about the request.
Randy Puttkamer, Town Board Supervisor and Baraboo Plan Commissioner stated that the Town recommends and would like to see approval. Puttkamer stated that the applicant’s business has been a wonderful addition to the area and clearly supported ag tourism.
Chair Krueger closed public hearing portion and went into deliberation at 12:15 p.m.
Motion by Polivka/Nelson to approve for a conditional use permit for an expansion of an agriculture-related business owned by A&L MC Inc based on the findings of facts and conclusion of law, subject to the staff analysis and conditions as noted. Motion unanimously approved.
i. Discussion and Possible Action on an Ordinance to Adopt a New Sauk County Chapter 51 Erosion Control and Stormwater Management Ordinance and to Amend Section 20.07, Chapter 20, Uniform Citation Ordinance.
Fowler appeared and presented the background and history.
Puttkamer stated the only concern that he has heard from other Townships was the cost that they may incur to handle these projects. Fowler explained that the Municipalities would be exempt from any fees. Nelson asked about the citation fees with the 365 days noted, and the level of enforcement. Wilson stated they would talk to Corp Counsel Desmond to clarify fees.

Discussion and possible action on an Ordinance Amendment to Chapter 10 County Parks.
Wilson stated that there were updates to the ordinance since the committee last saw the document, however, those changes
were some spelling and typographical errors. Wilson stated that staff was looking for an approval to bring Ordinance to the
Board floor.

Discussion and possible action to authorize the purchase and installation of a clear span arched bridge.
Meyer stated they received one bid from Custom Manufacturing in the amount of $42,900.00 for the purchase and installation of a clear span arched bridge. Motion by Kinsman/McAuliffe to authorize the purchase and installation of a clear span arched bridge in the amount of $42,900. Motion passed unanimously.
Discussion and possible action to authorize the purchase of a zero-turn mower.
Meyer stated they received two quotes for the Hustler Zero Turn Mower. Farmers Implement came in with the lowest quote
of $6,832.00 and River Valley Powersports quote was $10,743.00. Motion by Kinsman/Polivka to approve the purchase of
the Hustler Zero Turn Mower from Farmers Implement for $6,832.00. Motion passed unanimously.
Discussion and possible action on Final Project Report and Cost Summary for Dutch Hollow Lake’s 2021 Lake
Management Grant Funds.
Wilson presented the final report and is looking for approval for the final payment to be made for Dutch Hollow Lake 2021 Lake Management Grant Funds. Wilson stated all the requirements have been met. Motion by Polivka/ Curry to approve the final payment for the Dutch Hollow Lake 2021 Lake Management Grant Funds. Motion passed unanimously.
Discussion and possible action on a conditional use permit for a Planned Rural Development (PRD) lot for Von
Haden LLC, located in Section 36, T10N, R4E Town of Honey Creek, Sauk County, pursuant to Chap 7 Subchapter
IX, of the Sauk County Code of Ordinances.
Simmert presented the background and history of the request.
Nelson questioned if the map is correct. Simmert stated the map is correct.
Motion by Kinsman/Polivka to approve the conditional use permit for a Planned Rural Development lot for Von Haden
LLC. Motion passed unanimously.
