Conservation, Planning, and Zoning (CPZ) Committee members present: J. Ashford, N. Johnson, D. Polivka, J. Fish, J. Dietz, E. Peterson, C. Lehman.
Absent: None.
Others present: B. Cunningham, G. Templin, B. Simmert, M. Keenan, B. Michalek. See communications for others.
At 9:00 a.m. Chair Ashford called the Conservation, Planning, and Zoning Committee meeting to order and certified to be in compliance with the Open Meetings Law.
Adopt agenda: Motion by E. Peterson/J. Fish to amend the agenda with item 11 moving to be heard under item 6. Motion carried to adopt the agenda as amended. Motion carried, all in favor.
Adopt minutes of previous meeting with the correction of the election of “vice” chair– Motion by E. Peterson/N. Johnson to approve the October 8th CPZ Committee meeting minutes with change. Motion carried, all in favor.
Public Comment:
Glen Voorhees, grandson of the Sprechers who are neighbors of the property where the water extraction is proposed, is asking for a delay until a proper study can be done on the impacts of the well.
Roger Mack, Town of Troy Chair, feels that the Town Comprehensive Plan and County Comprehensive Plan does not fit this use, as well as the rezone would be a spot rezone and feels supporting this request would be negative and needs to represent the Town wishes.
Brian Hanson, spoke of the possible negative impacts of the trucking to and from the site, as well as water protection and current water shortage concerns in the State.
Don Meise, Supervisor with the Town of Troy, spoke of conditions of the Town roads and damage that the trucking will do the roads and spoke of the budget issues Town’s face to upgrade their roads.
Philip Hasheider, provided a written response to the memo written by Corporation Counsel. He also provided a written response to the statements made by the information presented by the Township.
Mary Hasheider, spoke of the process and the intent to share their water and view it as a local food product and asked for the committee’s support.
Communications:
a. Dam Failure Analysis Approval & Hazard Rating Assignment – Hemlock Dam. Cunningham spoke of the letter regarding the analysis and there is no requirement to do another FEMA study.
Cunningham provided a letter to the Committee that was received via email this morning from the Town of Franklin in opposition to the proposed rezoning for the water extraction facility.
Election of Vice Chair. Motion by J. Fish/J. Dietz to elect Dennis Polivka as Vice Chair of the Conservation, Planning and Zoning Committee. Motion carried unanimously. Secretary of the committee, now vacated by Polivka, will be elected at the next meeting.
Discussion and possible action on petition #26-2015, a rezone from an Exclusive Agriculture to a Commercial zoning district and conditional use permit to authorize a water extraction and removal facility pursuant to s.7.038(8) Sauk County Zoning Ordinance located in Section 5, T9N. R5E, Town of Troy, by Philip and Mary Hasheider. Motion by D. Polivka/N. Johnson to deny the rezone and conditional use permit based on the Town denial and legal counsel. Motion carried unanimously.
Introduction and update from Robert Bauer, Grazing Specialist, Southwest Badger. Robert Bauer introduced himself and explained what his role is with Southwest Badger and the work that they are assisting the Department with.
Land Records
a. Department reports and updates. Felton provided the Department report and spoke of the new GIS.
b. Review and approval of vouchers. Felton provided vouchers in the amount of $39,957.17 for October. Motion carried, all in favor. Motion by D. Polivka/E. Peterson to approve vouchers for in the amount of $39,957.17. Motion carried, all in favor.
Surveyor
a. Department reports and updates. Dederich provided the Department report.
b. Review and approval of vouchers. Dederich provided vouchers in the amount of $6,900. Motion by J. Fish/E. Peterson to approve vouchers in the amount of $6,900. Motion carried, all in favor.
Conservation, Planning and Zoning
a. Department report and updates. Cunningham reviewed the Department Report.
b. Review and approval of vouchers. Motion by D. Polivka/E. Peterson to approve vouchers in the amount of $6,000 and $53,662.28. Motion carried unanimously.
c. National Flood Insurance Program Audit Report. Cunningham reviewed a letter received regarding the audit completed by the DNR on the flood insurance program conducted by the Department.
d. Baraboo River RCPP Annual Report. Cunningham reviewed the summary provided by staff and the annual report developed by Schultz.
e. Updated Guidance Letter from DATCP. Keenan spoke of the updated guidance letter from DATCP regarding the farmland preservation program and compliance with the standards.
Discussion and review of Wisconsin Land and Water Annual Report. Keenan updated the committee on Sauk County’s exposure in the 2014 Wisconsin Land and Water Annual Report.
Discussion and review of process for updating Sauk County’s LWRM plan. Cunningham updated the committee on the process for updating the plan, a qualifier for federal funding and possible work for summer interns. Keenan spoke of tying into the inventory with the RCPP grant.
Discussion on Chapter 26, SCCO, manure management ordinance. Keenan spoke of the updates that need to take place to Chapter 26 as well as updates that DATCP had recently passed such as milk house and feed storage waste runoff enforcement. Cunningham spoke of cost sharing and local control.
Review and possible action on permit fees for permanent ground sign. Cunningham stated the property owner is requested that the original permit fees from the permit that was denied be used for the second permit be transferred and a refund of remaining fees. Motion by N. Johnson/E. Peterson to allow $100 to be used from the denied permit for the new permit, but no refund of remaining balance. Motion carried unanimously.
Supervisor Peterson recused himself at this time.
Discussion and possible action on a conditional use permit for a Planned Rural Development (PRD) lot (3 lots) for Lundgren/Peterson located in S9 and 30, T9N, R6E, Town of Prairie du Sac, Sauk County, pursuant to Subchapter IX, of the Sauk County Code of Ordinances. Simmert appeared and reviewed the PRD request being made. Simmert also mentioned that the Town of Prairie du Sac has not considered the proposal yet. Motion by D. Polivka/J. Fish to approve the PRD with the condition that the Town approve the request. Motion carried unanimously, with Peterson absent.
Supervisor Peterson rejoined the committee.
Consideration of a conditional use permit pursuant to S.7.074(3) of the Sauk County Zoning Ordinance for a dwelling in an area zoned exclusive agriculture on land located in S7, T12N, R4E, Town of Reedsburg, Sauk County, for Nick Casey. Cunningham reviewed the request for a conditional use permit for a dwelling in exclusive ag. Motion by N. Johnson/D. Polivka to approve the conditional use permit with conditions. Motion carried unanimously.

d. Economic Development Committee. Polivka spoke of the Intergovernmental meeting and Placemaking. Next meeting will be November 30th at UW Baraboo.
e. Mirror Lake District. Lehman stated she will get an updated.
f. Lake Virginia Management District. Fish provided an update.
g. Lake Redstone Management District. Johnson provided an update.
Next meetings of the Conservation, Planning, and Zoning Committee will be held on Tuesday, November 24, 2015 at 9:00 a.m. and Thursday, December 10, 2015, at 9:00 a.m. Motion by E. Peterson/D. Polivka 0jhjhhto adjourn at 11:15 a.m. Motion carried, all members in favor.
