At 9:00 a.m. Vice Chair Ashford called the Conservation, Planning, and Zoning Committee to order and certified to be in compliance with the Open Meetings Law.
Adopt agenda: Motion by Halfen/Polivka to adopt the agenda with the postponement of agenda item No. 6 (Review and authorization of chair to sign Farmland Preservation Program Notice of noncompliance) to the next CPZ Committee meeting on February 13, 2014, and to remove agenda item No. 10 (Possible approval of position on the Master Plan for the Sauk Prairie Recreational Area) and directed CPZ Department staff to prepare a background report for when it is placed on a future agenda. Motion carried, all in favor.
Adopt minutes of previous meeting-January 9: Motion by Polivka/Puttkamer to adopt the minutes from the January 9 Conservation, Planning, and Zoning Committee meeting. Motion carried, all members in favor.
Public Comment:
Laura Olah commented on the Sauk Prairie Recreational Area plan and provided materials to the CPZ Committee including a recommended Committee action and supportive documents.
Eugene Robkin commented on the Sauk Prairie Recreational Area plan.
Mary Carol Solum commented on the Sauk Prairie Recreational Area plan.
Eugene Robkin commented on the Sauk Prairie Recreational Area plan and the background report the CPZ Department was instructed to prepare.
Bev Vaillancourt provided “Study shows urban noise leads to less songbird diversity” to the CPZ Committee for their review.
Communications:
a. Letter of support to Southwest Badger Resource Conservation and Development for Aquatic Invasive Species grant from DNR: Michalek noted that a letter of support has been sent.
b. Letter for Lower Wisconsin Oxbow Lake Planning Grant application: Michalek noted that a letter of support has been sent in for the grant.
c. Memorandum from Wisconsin Historical Society notifying that the Devil’s Lake State Park is being considered by the Wisconsin Historic Preservation Review Board for nomination to the Wisconsin State Register of Historic Places and National Register of Historic Places.
d. Memorandum from Marty Krueger regarding postponement of Master Plan for the Sauk Prairie Recreational Area agenda item.
Review and authorization for chair to sign Farmland Preservation Program notice of noncompliance: Agenda item postponed to the February 13, 2014, CPZ Committee meeting.
Approval of 2013 Wildlife Damage Abatement Claim Program claim: Peterson presented the following four claims processed through the year which all have a $500 deductible: Thomas Toudout-$996.91, Gary and Harold Alt-$902.88, crop shared Reuben Graber and Mary Nachreiner-$762.61, Tim Johnson-$1,818.89. Motion by Halfen/Puttkamer to approve the claims as presented. Motion carried, all in favor.
Peterson noted that Straka Meats processed 17 deer for the 2013 Wisconsin Deer Donation Program amounting to $1,105.00. This is a reimbursable expenditure.
Possible approval of position on the Master Plan for the Sauk Prairie Recreational Area: Removed from agenda, and CPZ Committee directed CPZ Department staff to prepare a background report for when it is placed on a future agenda.
Review and possible approval of attendance at Wisconsin Land & Water Conservation Association Annual Conference - March 10-12: Motion by Polivka/Halfen to approve attendance for up to two CPZ Committee members to attend. Motion carried, all in favor.
Review and possible approval of attendance at Agricultural Community Engagement (ACE) meeting - February 19: Motion by Nobs/Halfen to approve attendance for up to two CPZ Committee members to attend. Motion carried, all in favor.
Committee recessed at 9:20 a.m. and resumed at 9:32 a.m.
Register of Deeds:
a. Department reports and updates: Bailey presented the department report.
b. Review and approval of vouchers: Motion by Nobs/Halfen to approve vouchers in the amount of $5,849.07. Motion carried, all in favor.
Committee recessed at 9:45 a.m. and reconvened at 10:00 a.m.
Public hearing: To begin at approximately 10:00 a.m. (Committee to consider and take possible action at the conclusion of the respective hearing):
a. Petition #3-2014. A petition to repeal and recreate Chapter 7 of the Sauk County Zoning Ordinance.
Ashford called the public hearing to order at 10:00 a.m. She explained the procedures for the public hearing and introduced the committee and staff members.
Simmert appeared and presented a staff report. The purpose of the public hearing is to repeal and recreate Chapter 7 of the Sauk County Zoning Ordinance and also a request by various towns that wish to adopt the new zoning ordinance.
The following handouts were provided to the CPZ Committee: Memorandum from DATCP dated January 24 regarding the Sauk County Farmland Preservation Zoning Ordinance, Sauk County Zoning Map under Petition 3-2014, Suggested Changes at the January 28, 2014 CPZ Committee Public Hearing.
Bev Vaillancourt, registered as interest may appear, spoke on accessory buildings for single family dwellings and provided two handouts to the Committee (the expired covenants for Lake Redstone and the town Policy on Approval of Request for Accessory Structures).
Seeing no one else wished to appear, Ashford closed the public hearing at 10:44 a.m.
Committee discussed the ordinance.
Todd Liebman addressed changing the ordinance to reflect the Town of LaValle’s concerns on accessory structures and being problematic applying this countywide.
Joe Fish spoke regarding accessory structures. His township has not had the same concerns.
Motion by Polivka/Nobs to approve Chapter 7 of the Sauk County Zoning Ordinance with all of the changes included and to send it to the County Board for adoption. Motion carried with Ashford, Dietz, Nobs, and Polivka in favor and Halfen opposed. Puttkamer is unable to vote on zoning issues.
Discussion and possible action to amend Chapter 20 Uniform Citation Ordinance s.20.07(3) related to forfeitures under Chapter 7: Zoning Ordinance: Motion by Polivka/Halfen to adopt Chapter 20. Motion carried, all in favor.
Next meeting of the Conservation, Planning, and Zoning Committee will be held at 9 a.m. on Thursday, February 13, at 9:00 a.m.
Motion by Halfen/Nobs to adjourn at 11:14 a.m. Motion carried, all members in favor.
