NOTE: It is possible that members of and possibly a quorum of members of other governmental bodies of the municipality may be in attendance at the above stated meeting to gather information; no action will be taken by any governmental body at the above stated meeting other than the governmental body specifically referred to above in this matter.

At 9:00 a.m. Chair Lehman called the Conservation, Planning, and Zoning Committee to order and certified to be in compliance with the Open Meetings Law.
Adopt agenda: Motion by Polivka/Ashford to adopt the amended agenda. Motion carried, all in favor.
Adopt minutes of previous meeting-August 14 and 28: Motion by Polivka/Dietz to adopt the minutes from the August 14 and 28 Conservation, Planning, and Zoning Committee meetings. Motion carried, all members in favor.
Public Comment:
Johnson arrived at 9:02 a.m. Puttkamer arrived at 9:03 a.m.
a. Scholarship recipient presentation - Cliff Thompson, Sauk Prairie Schools Superintendent/District Administrator, thanked the CPZ Committee for offering these scholarships. Sauk Prairie teacher Jill Hunger received the 2014 teacher scholarship to attend the UW-Madison Bioenergy Institute II in August. She presented information she learned in the course and thanked the CPZ Committee for the scholarship. She offered to come back and do a presentation for the CPZ Committee and could open up to the public.
Communications:
a. NRCS Sees Overwhelming Interest in Cover Crops - Michalek highlighted the article, and the committee discussed cover crops.
b. DATCP correspondence regarding Hegwood v. Town of Eagle Board of Appeals decision -Michalek detailed the case to the CPZ Committee.
c. Public Notice of Availability of a Nutrient Management Plan and Intent to Issue a Wisconsin Pollutant Discharge Elimination System (WPDES)-Karl Hausner Farms LLC.
d. Public Notice of Intent to Reissue a WPDES-Spring Green Wastewater Treatment Facility.
e. Workshop for Local Officials: Understanding Conditional Uses and Special Exceptions - All CPZ Committee members will attend this workshop. Committee meeting will begin at 5:45 p.m.
f. Letter from the Federal Emergency Management Agency (FEMA) regarding the proposed flood hazard determinations.
g. Newspaper article “Judge rules against DNR on high-capacity well issue.” Pohle will forward article to Polivka and Johnson.
h. Sheriff’s Department offering “Learn about Updated Laws on How Farm Machinery Operates on Wisconsin Roads” presentation.
i. Alliant Energy’s Celebration for the 100th Anniversary of the Prairie du Sac Dam on September 12.
Review and possible approval of 2015 Wildlife Damage Abatement and Claims Program (WDACP) budget: Peterson gave a brief background of the Wildlife Damage Program and how the program is funded (primarily from surcharges off of hunting licenses). There is no cost to the county. The program’s total funding is $15,126.50, but $12,221.45 is the amount Sauk County will be billed and reimbursed. This is a $120 decrease from 2014 and more farmers are actually being dealt with than last year. This covers salaries, mileage, fuel, fencing, venison donation program, etc. Motion by Puttkamer/Ashford to approve the 2015 WDACP budget. Motion carried, all in favor.
Consider approval of participation in 2014 Venison Donation Program: The Venison Donation Program was approved last year in the 2014 budget. This program is offered at no cost to the hunters who choose to process their deer and donate the meat to food banks. There have been some problems getting deer processing facilities to participate due to disposing of bones from CWD deer. Motion by Polivka/Johnson to approve participation in the 2014 Venison Donation Program. Motion carried, all in favor.
Establish 2014 crop damage price values: Will be handled at a future meeting.
Discussion on commemorating Zantow: Todd Zantow, Donna Stehling, and Pohle presented on Milly Zantow’s recycling efforts and possible ways to commemorate her, Jenny Ehl, and Lillian Blanchette. Pohle will keep the CPZ Committee updated.

Lehman called the public hearing to order at 10:04 a.m. He explained the procedures for the public hearing and introduced the committee and staff members.
Simmert appeared and presented a staff report.
Matthew Long and Scott Groholoski, appearing and registering in favor, presented on the expansion of Tower Rock Elementary School.
Cliff Thompson, appearing and registering in favor, discussed the project.
Judy Weinstock, appearing and registering in favor, did not wish to speak.
Seeing no one else wished to appear, Lehman closed the public hearing at 10:47 a.m.
Motion by Dietz/Polivka to approve the rezone.
Committee discussed the rezone and the number of parking spaces being proposed.
Motion by Ashford/Fish to amend the original motion to add positive answers to items listed in Sections 3, 4, and 5. Motion amendment carried, all in favor
Original motion to approve the rezone carried, all in favor. Puttkamer unable to vote on zoning matters.
Discussion and possible action on a conditional use permit for a Planned Rural Development (PRD) lot for Rolling Valley Farm, LLC located in S34,T.11N.R.6E and S9&17,T10N.R.6E Town of Sumpter, Sauk County pursuant to Subchapter IX of the Sauk County Code of Ordinances: Simmert presented the proposed PRD lot. Wenzel noted he had contacted DOT, and there are no plans to alter this part of Hwy. 12. Nancy Groth and Clayton Bare were also present. Motion by Polivka/Johnson to approve with the conditional use permit sections being approved and to locate the PRD easement on the south 30 acres of the two identified quarter quarter sections. Motion carried, all in favor. Puttkamer unable to vote on zoning matters
Update on Chapter 7 and discussion on the creation of a new residential zoning district (SFR2): Ironton Township and LaValle Township are on hold for approving Chapter 7. Discussed the meeting held at the Town of LaValle on August 28. CPZ Department is planning to present all the ordinance changes at one time by bringing the changes to the CPZ Committee in late September/October and hold a public hearing in November. Consensus of the CPZ Committee is to leave the portion regarding the residential zoning district as it is currently written. Committee does not recommend adding the new SFR2 district.
Consideration of a conditional use permit pursuant to 7.074(3) of the Sauk County Zoning Ordinance for a dwelling in an area zoned exclusive agriculture on land located on CSM 5729 for Jim Greenwood & Bernadette Scheller S24, T12N. R5E, Town of Excelsior, Sauk County: Michalek explained the situation needing these conditional use permits to come before the CPZ Committee. County staff discussed this with DATCP. It was not their intent to send these through a conditional use permit, and they agree with our interpretation. Need to change the fee in exclusive agriculture that nonconforming lots of record not be charged $100 fee. Motion by Ashford/Polivka to approve the conditional use permit for Jim Greenwood and Bernadette Scheller. Motion carried, all in favor.
Discussion and possible action on Exclusive Agriculture zoning, to include ordinance and/or possible fee schedule amendment: Motion by Johnson/Ashford to approve not charging a conditional use permit fee for a residence on legal nonconforming lots of record in exclusive agriculture zoning. Motion carried, all in favor.
Review of County Farm proposed conservation plan and lease agreement: Koenig is working on county farm lease with Keenan. Crop insurance is not an issue as long as the crop is not being harvested. Trying to make the county farm a demonstration farm and for us to be a leader in the area. May receive a lower bid because of the cover crop requirements. A $3,000 security deposit will be required. Will go out for bids in October and bring back before the CPZ Committee in November. Current renter planted some cover crops, and the progress is being documented. Consensus of CPZ Committee members to send out for bids.
Discussion and possible action to approve a proposal from Mays | Wilson & Associates, LLC to facilitate a comprehensive review of the structure and composition of the Badger Oversight and Management Commission (BOMC): Michalek and Ashford summarized the bids received. The BOMC selected Mays | Wilson & Associates, LLC and will make their formal decision next Thursday. Since this expenditure is part of the CPZ Department’s budget, it needs to come through this committee for approval. There is $30,000 remaining in the budget for BOMC expenditures. Motion by Dietz/Johnson to approve the Mays | Wilson & Associates, LLC proposal for the BOMC. Motion carried with all in favor except Polivka was opposed.
Discussion and possible action on Sauk County's 2015 dues to the Southwest Badger Resource Conservation and Development (RC&D): Lehman noted that other counties in the Southwest Badger RC&D area are not paying the full $2,500 membership dues in 2015, and other Wisconsin RC&D dues are considerably less than $2,500. It was decided to have CPZ Department staff check with Corporation Counsel to see if there are any membership requirements for Sauk County to belong to the Southwest Badger RC&D. Will bring back at a future meeting.
Conservation, Planning, and Zoning Department:
a. Department report and updates: Michalek presented the department report. Gillettes in Greenfield requested to have a site visit as part of the meeting for their public hearing. Decided to meet at the Gillette site at 8:30 a.m. and start the meeting at the West Square Building at 9:15 a.m.
b. Review and approval of vouchers: Motion by Ashford/ Polivka to approve the vouchers totaling $29,802.47. Motion carried, all in favor.
a. Regional Conservation Partnership Program (RCPP) update: Michalek updated the CPZ Committee that both the Finance Committee and the Personnel Committee unanimously approved hiring an additional person for RCCP if the department receives the project approval in November.
Reports:
a. Natural Resources Conservation Service (NRCS): None.
b. Farm Service Agency (FSA) report: Processing a few continuous Conservation Reserve Program (CRP) sign ups. Margin Protection Program for dairy has a signup until November 28. Base and yield selections will be coming this fall for the Agricultural Risk Coverage (ARC) and Price Loss Coverage (PLC) programs. Livestock Forage Program (LFP) applications are still coming in for grazing losses in 2012.
c. Foresters’ report: None.
d. Economic Development Committee report: Polivka reported that Bug Tussel Wireless is planning on constructing another eight towers in Sauk County in the future.
e. Mirror Lake District report: Lehman did not attend the annual meeting.
f. Lake Virginia Management District report: Joe Fish will attend their next meeting.
g. Lake Redstone Management District report: Johnson reported their aquatic plant management plan will be approved soon.
Discussed providing copies to CPZ Committee members of conditional use permits by email or posting them on the website. Michalek is working with the MIS Department and will report back at a future meeting.
Next meetings of the Conservation, Planning, and Zoning Committee will be held on Tuesday, September 23; Tuesday, September 30; Thursday, October 9. The October 28 meeting may be changed to Thursday, October 30, depending on the public hearing applicants’ availability on that date. Motion by Ashford/Johnson to adjourn at 12:47 p.m. Motion carried, all members in favor.
