SAUK COUNTY BOARD OF ADJUSTMENT

                                                  June 23, 2016 Session of the Board

Vice Chair Kettner called the session of the Sauk County Board of Adjustment (BOA) to order at approximately 9:00 A.M.  The Acting Chair introduced the members of the Board, explained the procedures and the order of business for the day.  The staff certified that the legally required notices had been provided for the scheduled public hearing.  The certification of notice was accepted on a motion by Allen, seconded by Netzinger .  Motion carried, 5-0.

The Board adopted the agenda for the June 23, 2016 session of the Board on a motion by White, seconded by Allen.  Motion carried, 5-0.

The Board adopted the minutes from the May, 2016 Board of Adjustment meeting on a motion by Ladas, seconded by Netzinger.  Motion carried 4-0 with White abstaining.

COMMUNICATIONS: 
None.

DISCUSSION AND POSSIBLE ACTION ON AN APPEAL POSTPONED AT A PREVIOUS HEARING.

Motion by White, seconded by Allen to bring SP-07-16 back for discussion.  Motion carried, 5-0.

Motion by Netzinger, seconded by Ladas to reopen public hearing to hear from the Applicant.  Motion carried, 5-0.

A.        Bill Hetzel (SP-07-16) requesting variance and special exception permit to authorize the repair and operation of a proposed lodging house.

Steve Sorenson, Conservation, Planning and Zoning, provided a history of the request and provided a copy of the ordinance and provided Exhibit VIII,1, which is a copy of Chapter 7, Sauk County Zoning Ordinance in relation  to road setbacks. 

White asked if this applies if the prior owner had the building and if it currently is involved with a farm.  Sorenson explained that it states that it implies currently or historically.

White asked about change of use from ag use to residential use.    Sorenson explained that the use is the special exception use. 

Netzinger asked for the history of this property, the zoning of the property and the allowed uses.  Sorenson explained.

White asked if the variance is needed.  Sorenson stated based on this ordinance, a variance would not be needed and the board could focus on the special exception request.

White asked about the size, septic and the use.  Sorenson explained.

Netzinger asked about the existing sanitary.  Sorenson stated he does not and will need permits to convert the shed to single family and put in a sanitary system.

White asked if he can use it for housing as long as he doesn’t charge for it.  Sorenson stated he can as long as he has a permit.

Bill Hetzel, applicant, appearing in favor of the request, spoke of the history of the building and property.

White suggested adding conditions that the permit be non-transferrable as well as suggesting an expiration date.

Seeing as no one else wished to appearing, Acting Chair Kettner closed the public portion of the appeal at 9:25 a.m. and went into deliberation.

The board spoke of not needing a variance.

Motion by White, seconded by Ladas to approve the Special Exception permit for a lodging house, adding condition H that the permit is non-transferrable, as well as adding the operating procedures as an attachment to the list of conditions.  Motion carried, 5-0.

Motion to adjourn by Netzinger, seconded by Ladas.  Motion carried, 5-0.
