Resolution to Designate Attolles Law, s.c., as Performing Certain Duties of Corporation Counsel as the Need Arises Under Wis. Stat. § 59.42(3) Under Terms of Previously Approved Engagement Letter

Purpose

BACKGROUND: Due to the resignation of Corporation Counsel Brian Desmond, and the subsequent resignation of Assistant Corporation Counsel Nicholas O’Connor (who served as Interim Corporation Counsel after Mr. Desmond’s resignation), there is a need for attorneys to perform the duties of corporation counsel as the need arises.  The County currently contracts with Attolles Law to perform certain duties typically undertaken by Corporation Counsel and, as well, contracts with other attorneys for certain other duties.  The Executive and Legislative Committee has considered the options and agrees to engage Attolles Law to continue its representation of the County as needed and as directed by the County Administrator. 

Resolution Body

THEREFORE, BE IT RESOLVED, that the Sauk County Board of Supervisors, who met in regular session, hereby approves the engagement of Attolles Law to perform certain duties of Corporation Counsel pursuant to Wis. Stat. 59.42(3) as directed by the County Administrator and to serve at the pleasure of the County Board; and,

 

BE IT FURTHER RESOLVED, that the previously approved Engagement Letter shall continue to govern the terms and conditions associated with Attolles Law’s work and that, except as specifically provided in the Engagement Letter, Attolles Law is subject to all Sauk County resolutions, ordinances, policies, and no employment contract or relationship is being made by this resolution or appointment, and further that Attolles Law shall be relieved of service through the mechanisms stated in the previously approved Engagement Letter. As set forth in the Engagement Letter, this engagement does not apply to services that Attolles Law, s.c., provides to the County in conjunction with its assignment as counsel by the County’s insurer, which assignment is governed by the terms of the contract between the County and its insurer, which is administered by the County Administrator.
