BOA Special Exceptions

Special Exception Permit Standards:

Special exception permits shall be granted only when the location of each such use shall have been approved in writing by the Board of Adjustment, after a public hearing. Any permits issued shall be consistent with the general purpose and intent of the district and ordinance and shall be based on such evidence as may be presented at the public hearing and consideration of the following factors in making its decision.

  • That the establishment, maintenance or operation of the special exception use shall not endanger the public health, safety or general welfare.
  • That the establishment, maintenance or operation of the special exception use will not substantially affect the existing use of adjacent properties.
  • The adequate utilities, septic system, roads and parking are provided.
  • That the special exception use shall conform to all governmental regulations pertaining to the activity itself.
  • That the special exception use will not be an unreasonable burden to local government.
  • That the land and buildings are suitable for the special exception use.

Application Policies to apply for a Special Exception with the Board of Adjustment

Applicants must submit the following information before they will be put on the agenda to have their appeal heard by the Sauk County Board of Adjustment.

  • Notice of Appeal – Special Exception Permit. This application must be completely filled out with as much detailed information as you can give. It shall be signed and dated, acknowledging that all information submitted is accurate. A $500.00 fee is required and checks should be made payable to Sauk County Board of Adjustment.
  • A letter of explanation. This letter should include why you feel your request meets the requirements to have a special exception permit granted. Those standards include:
    1.  How the establishment, maintenance or operation of the special exception use shall not endanger the public health, safety or general welfare.
    2.  How the establishment, maintenance or operation of the special exception permit will not substantially affect the existing use of adjacent properties.
    3.  How you will provide adequate utilities, septic system, roads, and parking provided if applicable.
    4.  How the special exception use shall conform to all governmental regulations pertaining to the activity itself.
    5.  How the special exception use will not be an unreasonable burdon to local government.
    6.  How the land and building are suitable for the special exception use.
  • Acknowledgement Form from your local Town Board. You should speak to your town board chair and/or clerk. After speaking to them about your request, please have them sign and date this form and fill in the date when they will be able to discuss your appeal with the full board. This form can be turned in prior to meeting with the full town board. It is merely an acknowledgement that they have been advised of your request.
  • Required Plans: Depending on the special exception use you are requesting, there is a required set of plans that shall be submitted. All request MUST have a complete plot plan submitted. For example with a filling and grading request – erosion control plan and planting plans are required as part of the application. For a junkyard operation, you must submit an operational plan, materials handling plan, erosion control and/or surface water control plan, tree planting/screening plan, etc shall be submitted. Some request also require stormwater management plans. Please be sure to ask a Planning and Zoning Staff member which specific plans are required for your request.
  • Extra copies. Anything you submit to have made into an Exhibit with your appeal shall be 8½x11 to 11x17 in size. Any color copies of any size and/or any materials larger than 11x17 shall have 7 copies with numbering sequence on all pages, starting with the cover, submitted with your application.
