Resolution to Disallow the Claim of Gabriel Sauers

Background

Gabriel Sauers filed a Notice of Claim with the Sauk County Clerk’s Office on May 20th, 2022. (see the attached Exhibit A). The notice of claim alleges that Sauers’ windshield was damaged by a rock that fell off a Sauk County Highway Department vehicle. The Notice of Claim has been referred to the County’s appropriate insurance carrier who has determined that the claim may be formally disallowed by Sauk County.

Resolved by the Board of Supervisors of Sauk County, Wisconsin:

 

BACKGROUND: Gabriel Sauers filed a Notice of Claim with the Sauk County Clerk’s Office on May 20th, 2022. (see the attached Exhibit A). The notice of claim alleges that Sauers’ windshield was damaged by a rock that fell off a Sauk County Highway Department vehicle. The Notice of Claim has been referred to the County’s appropriate insurance carrier who has determined that the claim may be formally disallowed by Sauk County.

 

NOW THEREFORE, BE IT RESOLVED, that the Sauk County Board of Supervisors does hereby disallow the claim of Gabriel Sauers, 316 Cherry Alley, Baraboo, WI 53913, and that no action on this claim may be brought against Sauk County or any of its offices, officials, agents or employees after six months from the date of service of this notice.

 

BE IT FURTHER RESOLVED, that a copy of this resolution be forwarded to the claimant by registered or certified mail, as a notice of disallowance.

 

BE IT FURTHER RESOLVED, that the Sauk County Board of Supervisors does hereby reserve any and all defenses to the claim related to compliance with Wis. Stat. § 893.80.
