Executive and Legislative Committee Special Meeting

Chair Krueger called the meeting to order at 6:00 P.M. and compliance with the Open Meeting Law was verified. MOTION (Lane/Fordham) to adopt the agenda. Motion carried unanimously.
Public Comment.
- Linda Meadowcroft, re; suggested changes to the Rules of the Board.
Communications.
- CEO/Dean Search Advisory Committee – Chair appointment by Chancellor Aaron Brower.
Consideration of the Rules of the Board.
Liebman, Corporation Counsel, distributed a revised draft document containing most the most recent additions and withdrawals received for the Rules of the Board containing proposed amendments from supervisors and staff. Chair Krueger proceeded with an explanation of the process, in which each proposed amendment will be reviewed to be legally sufficient; requiring a motion and second for approval and consideration at the March 6 Executive & Legislative Committee meeting. The following proposed amendments will be incorporated into a draft copy of the Rules of the Board for review.
IV. J. Supervisors are required by law to sign or indicate their vote on any question presented to the Board, except when voting for the officers of the Board or other governing body. When written ballots are used, supervisors shall indicate their vote by placing their |

Health Care Center Board of Trustees.

Move from a Board of Trustees to a standing committee of the County Board.

The Board of Trustees was created in accordance with Wis. Stat. s. 46.18, and Sauk Co. Code ch. 46 governs the BOT. If the Board desires to do this, it will require a repeal of Sauk Co. Code ch. 46 and an accompanying board action to do so. A change to the ROB does not accomplish this. |
- Health Care Center Board of Trustees. Carlson addressed the committee with his request for this change to move it from a Board of Trustees to a standing committee. Liebman explained this goes beyond a change in the Rules of the Board and should be handled initially at the Executive & Legislative committee for discussion as the Board of Trustees is governed by a Sauk County ordinance. MOTION (Fordham/Lane) to place on March Executive & Legislative committee for further discussion. Motion carried unanimously.
Tri-County Airport Commission

Request to have the Tri-County Airport Commissioner be a citizen member at the discretion of the Board Chair.

There is no legal requirement that the Tri-County Airport commissioner be a board member, and in fact, commissioners serve a six year term, so a supervisor who leaves the Board would continue to serve until the expiration of their six year term. |
- Tri-County Airport Commission. Liebman advised there is no legal requirement that this commissioner be a board member. The commissioners serve a six-year term so inevitably a supervisor who leaves the Board would continue to service until the expiration of their six-year term. No action taken.
V A. Supervisors shall be authorized up to a maximum of 90 days' compensation (at a per diem rate of $60.00 for each day of attendance when the Board is in session and meetings, and $50.00 for other authorized service including committee meetings), plus mileage and reimbursement of authorized expenses, for committee work when attending committee meetings of which they are members, or as chair of a committee (or their designee) when attending a committee meeting of which they are not a member for the purpose of providing testimony on an issue. … |
No specific language proposed, but the request is to have additional per diems for multiple committee meetings on the same day, or in the alternative, move to a salary system for county board members. |

Wis. Stat. s. 59.10(3)(h) limits compensation. Multiple per diems are not lawful. A salary is lawful pursuant to Wis. Stat. s. 59.10(3)(i) but no change can be made now. Changes must be made at the Annual Meeting of the Board in the year prior to the election and be adopted by a 2/3 vote. (Wis. Stat. s. 59.10(f)) |
- V A. Held addressed committee with her concerns and information she has collected from other counties. Liebman explained changes are not appropriate at this time and must be made at the Annual meeting of the Board in the year prior to the election (Wis. Stat s. 59.10(f)) with a 2/3 vote. No action taken.
- NEW RULE: IV S. All meetings of the County Board & Standing Committees will be videotaped and made available for public viewing with 3 days of the end of each meeting.
Consensus of committee this does not belong as part of the Rules of the Board. The Communications Infrastructure Committee should be the proper committee for further discussion and evaluation. No action taken.

Provides policy direction and oversight on behalf of the Board to the following departments: District Attorney, Coroner, Clerk of Courts, Court Commissioner, Register in Probate, Child Support, and Circuit Court Judges, Sheriff, Emergency Management, and the Animal Shelter.

Wis. Stat. s. 323.14(1)(a)2 requires that a county designate an emergency management committee with the chair designating the chair of the committee. |
This is the most feasible approach to resolving Sauk County’s current non-compliance with the statute. Two other approaches would be to create a new, standing emergency management committee with the chair appointed by the County Board Chairperson. In the alternative, emergency management could remain with Law Enforcement & Judiciary, but a special rule would have the chair of that committee appointed by the County Board Chairperson. |

- Economic Development Committee. MOTION (Stevens/Lane) to add change to current resolution for the Intergovernmental Agreement for the Great Sauk Trail Commission eliminating the trail subcommittee. Motion carried unanimously.
MOTION (Stevens/Fordham) to adjourn. Motion carried unanimously and the meeting adjourned at 8:44 P.M.
