The Badger Interim Oversight Management Commission (IOMC) convened at the Badger Army Ammunition Plant Bldg 207 for its regular meeting on Thursday, March 18, 2010.
Acting Chair Judy Ashford called the meeting to order at 6:45 pm. Staff affirmed compliance with Open Meetings Laws.

Motion by Carr, seconded by Hammes to approve the agenda. Short discussion followed regarding the word “interim”. Motion carried.
Motion by Holst, seconded by Karr to approve the minutes with minor changes correcting the spelling of a couple members names. Motion carried.

Commissioner Reports:
Craig Karr, DNR – Discussed projects he is working on through the DNR and presented handouts (same hand out that were emailed with agenda).
Hammes asked if there is any money planned on being spent at BAAP. Karr spoke of money for the planning work that is going on, but stated there is no budget money from Devils Lake for any work at BAAP He then spoke the process of requesting money once the property is in place.
Olah spoke of Natural Resource Board agenda, the planning for BAAP and Baraboo Hills recreation area.

HoChunk - Greendeer stated that in January the BIA took military land into trust for a tribe, one of two docketed land claims that sits ahead of the HoChunk request for lands at Badger and stated she feels the Interior will move forward. She spoke of a press release, which she will share with commission via email and explained the liability with contaminated properties and how the BIA and Interior Secretary would become involved due to remediation.
John Holst spoke of a meeting next week with county officials throughout the State in regards to the gaming compact to allow the ability to give to counties “x” amount of dollars for every acre of land they have in trust. Sauk has a large amount of land that will be part of that negotiation and recommend that part of that money that goes to Sauk County that they ear mark some of that to this process.
Committee Reports:
Executive and Finance – no report
Planning and Land Use: Karr referred to the agenda item under new business and would discuss at that time.
Education and Outreach: Alison Duff stated the committee has not met. However there are 3 events in April and May, with assistance from Alliant Energy. April 9, National Association of Interpretation is doing a tour of BAAP with Aldo Leopold Foundation and she is assisting with contacts. Will be at BAAP for a half day and Badger History Group will be in Building 207 on the same day. May 7 Natural Resources Foundation will lead birding tour of BAAP from 7 to 11, 25-30 people. May 8, Natural Resources Foundation and National Alumni are doing tour. She suggested taking advantage of Building 207 to reach out to the other groups.
Ad Hoc Committees: No report.
Liaison Reports:
Army: Joan Kenny provided environmental protection provisions. She spoke of land use restrictions specifically only in areas marked off where explosives existed. Reviewed MEC and reviewed action taken for friable asbestos and trying to remove as much of any kind as possible, although language for legal warning still goes through. She talked about lead based paint, assuming everything here is lead based paint and have found low levels of PCB in some of the low grade paint on buildings.
Robin asked which parcel is getting the restrictions. Joan and Craig reviewed using large map and the map provided in the packet.
Karr asked if any of this is new language. Joan stated only new language is PCB language.
Olah asked about the restriction is less than 4 feet, but there will be some areas that will be shallower. Joan stated the digging is assuming you are going below 4 feet. Where there is a cap is where there is a no dig site.
Olah then asked if a soil clean up goal has been established for friable asbestos. Joan stated you don’t investigate soil for friable. If you see it, you clean it up. Visual inspection and certification done for every building. Joan then clarified PCBs = studies that refer to PCBs and caulking and limiting just to paint and intent is to clarify that there could be other possible sources of PCBs besides paint. Joan stated she doesn’t know if there is a test of caulk. She recommends adding caulk to the possible sources.
She then reported, April 1 for the DNR transfer. 1853.90 acres, showing on k, k1, k2, k3, l, n, w, and m2 areas shown on the map. Goal is additional parcels, s2, p2,4,5 would go in second transfer before September 30th. Town of Sumpter (cemeteries) is tentatively set for the spring, but it has not gotten on towns agenda, so not sure where the process is. Also the Bluffview transfer, wells (small -1 acre south of building 207 (r2) and waste water treatment plant in the works as well. Next discussion is BIA. 819 acres ready to transfer by September (north end and center green part of the land for the BIA). K4, O, O1, O3, O2, O4 O5, O7, O6, P1, Q1, Q2, U2.
2021 acres ready as of last week another 1151 to try to accomplish by September.
Olah and Robin then questioned in more detail the digging of foundations. Olah also asked for the test results from the study done at Wiegands Bay North from a couple years ago. Kenney stated she would look into them and share whatever she may have.
US Dairy Forage Research Center: Walgenbach stated that there has been no new information regarding the building project at BAAP and spoke of some staff changes.
New Business:
1. Craig Karr, discussion and possible action of Land Use Guidelines. Karr provided a hard copy of the concept plan and asked for approval of the management guidelines by the commission. Discussion followed. Motion by Ashford, seconded by Wenzel to adopt the Guidelines for Land Use. Motion carried.
2. Allison Duff, discussion regarding Federal Appropriations Request. Duff spoke of appropriations request made to Tammy Baldwins office on behalf of the Commission. Copies of the request were provided via email with the agenda. Discussion followed and she stated that they should hear something by September 1 as to whether any appropriations were granted.
Hammes spoke to the commission about teaming with the Wildlife Program as a possible funding source and reviewed lobbying that he did in the past month and is hoping for a share of the requested money to go towards a staff person and restoration project. The commission continued to discuss.
