NOTICE OF MEETING
SAUK COUNTY BOARD OF ADJUSTMENT

ORDER OF BUSINESS
1. Call to order, certification of open meetings notice.
2. Approval of agenda.
3. Approval of minutes of previous meeting.
4. Communications.
5. Board of Adjustment public hearing beginning at 9:00 a.m.
A. D.L. Gasser Construction, (SP-03-16), a special exception permit to renew and modify a permit to continue mineral extraction. The property is described as; lots 1 & 2 CSM 3841, part of the N ½, and part of the NW ¼, SE ¼, section 22. Town of Baraboo.
6. Possible viewing of sites with the time and location to be announced at the hearing. Viewing will take place the date of the hearing prior to adjournment.
7. Adjournment.

Chair White called the session of the Sauk County Board of Adjustment (BOA) to order at approximately 9:00 A.M. The Acting Chair introduced the members of the Board, explained the procedures and the order of business for the day. The staff certified that the legally required notices had been provided for the scheduled public hearing. The certification of notice was accepted on a motion by Allen, seconded by Netzinger . Motion carried, 5-0.
The Board adopted the agenda for the March 24, 2016 session of the Board on a motion by Netzinger, seconded by Kettner. Motion carried, 5-0.
The Board adopted the minutes from the February 25, 2016 Board of Adjustment meeting on a motion by Allen, seconded by Netzinger. Motion carried, 4-0 with White abstaining.
COMMUNICATIONS:
None.
APPEALS:
A. Gary and Diane Moseman (SP-04-16) requesting a special exception permit to renew a permit to continue mineral extraction.
Dave Lorenz, appeared and gave a brief history and background of the property, as well as reviewing photos and a video of the site. He verified that the Town of Baraboo, Village of West Baraboo, City of Baraboo, Baraboo Chamber of Commerce and Baraboo –Dells Airport have all recommended approval of the request. He then recommended conditions to be placed on the appeal if the request were approved.
Seeing as no one else wished to appear, Chair White closed the public portion of the meeting at approximately 10:27 am.
Wernecke spoke of the granting of the permit with the existing house and then granting the permit with the extension of the hours to meet contract obligations. He spoke of the emergency situations that may be requested by a government agency.
Kettner spoke of the contracts requiring that work be done at night, as not to impact the daily routine of the rest of the community. He spoke of the economic impact on the community.
Wernecke spoke of the extended hours being included in the approval for all 5 years and tying into the language of the 2012 permit.
Netzinger spoke of the jake-braking and felt the applicant has addressed the issue. Kettner appreciates that the applicant is taking the responsibility holding the drivers responsible and implementing a consequence for not following the policy.
Motion by Allen, seconded by Wernecke, to approve the special exception permit to renew and modify the permit to continue mineral extraction, with the conditions from Conservation, Planning and Zoning, including the extended hours as requested, with conditions applied from the 2012 permit/decision. Motion carried 5-0.
Motion to adjourn by Netzinger, seconded by Wernecke. Motion carried, 5-0.
