SAUK COUNTY BOARD OF ADJUSTMENT
June 28, 2018  Session of the Board

Vice Chair Kettner called the session of the Sauk County Board of Adjustment (BOA) to order at approximately 9:00 A.M.  The Chair introduced the members of the Board, explained the procedures and the order of business for the day.  The staff certified that the legally required notices had been provided for the scheduled public hearing.  The certification of notice was accepted on a motion by Allen, seconded by Mercier.  Motion carried, 4-0.

The Board adopted the agenda for the July 26, 2018 session of the Board on a motion by Mercier, seconded by McAuliffe.  Motion carried, 4-0.

The Board adopted the minutes from the  June 28, 2018 Board of Adjustment meeting on a motion by Allen, seconded by McAuliffe.  Motion carried 4-0.

COMMUNICATIONS: 
None.

APPEALS:

A. Margaret Gitter (SP-13-18), requesting a special exception permit to authorize the location and operation of a proposed lodging house.  The property is described as: S5620 Sugar Rd, part of the SE ¼, SE ¼, Section 12, Town of Freedom.

Lorenz, Conservation, Planning and Zoning, appeared and provided a background and history of the request.  He reviewed the video and photos of the property and concluded with recommendations if the appeal is to be approved.

Kettner asked about the size of the pond.  Lorenz stated about 4-5 acres.

Kettner asked if the applicant was given a copy of suggested house rules.  Lorenz explained the applicant was given a copy of the ordinance.

Margaret Gitter, applicant, appearing in favor, stated she has owned the property for about 19 years and would like to have the income to maintain the property and offset taxes and eventually move out here.

Kettner asked if the water, plumbing, electric, etc, is all up to code.  Gitter stated that she has been working with the State to verify that everything is up to code.   She also spoke about meeting with the Town of North Freedom and having the request approved.

Kettner asked who will be supervising and maintaining the property.  Gitter stated she will be coming 2-3 times a month, however, she has hired someone who will be taking care of the lawn and cleaning, as well as plumbing, etc.  

Kettner verified if something happens in the middle of the night there is an emergency contact number.  Gitter stated she does.

Kettner asked if she has spoken to all the neighbors.  Gitter stated she has spoken to the neighbors but it would be a good idea to provide them with emergency numbers.

Kettner asked if she received a copy of  suggested rules, such as camping, cars, noise limitations.  Gitter stated she doesn’t believe she received it.  Kettner stated they have been suggesting they use that as a minimum base for house rules.

Seeing as no one else wished to speak, Vice Chair Kettner, closed the public hearing at 9:30 a.m., and the Board went into deliberation.

Allen asked about verification from an email from the Town of Freedom. 

Motion by Allen, seconded by Mercier to approve the special exception permit to authorize the location of a lodging house, based on the department receiving approval from the Town of Freedom, and a copy of house rules, as well as with the recommended conditions from the Conservation, Planning and Zoning Department.  Motion carried 4-0. 

Motion by Mercier, seconded by McAlliffe, to adjourn at 9:35 a.m.  Motion carried, 4-0.
