Board of Adjustment public hearing beginning at 9:00 a.m.
A. Gary & Diane Moseman, (SP-04-16), a special exception permit to renew a permit to continue mineral extraction. The property is described as; part of the SE ¼, SW ¼, section 25, Town of Troy.
B. Gilbert & Jean Burmester, (SP-05-16), a special exception permit to renew a permit to continue mineral extraction. The property is described as; part of the N ½, NE ¼, NW ¼, and N ½, NW ¼, SE ¼, section 1, and N ½, NW ¼, SW ¼, section 6, Town of Franklin. -
Possible viewing of sites with the time and location to be announced at the hearing. Viewing will take place the date of the hearing prior to adjournment.

Chair White called the session of the Sauk County Board of Adjustment (BOA) to order at approximately 9:00 A.M. The Acting Chair introduced the members of the Board, explained the procedures and the order of business for the day. The staff certified that the legally required notices had been provided for the scheduled public hearing. The certification of notice was accepted on a motion by Allen, seconded by Netzinger . Motion carried, 5-0.
The Board adopted the agenda for the March 24, 2016 session of the Board on a motion by Netzinger, seconded by Kettner. Motion carried, 5-0.
The Board adopted the minutes from the February 25, 2016 Board of Adjustment meeting on a motion by Allen, seconded by Netzinger. Motion carried, 4-0 with White abstaining.
COMMUNICATIONS:
None.
APPEALS:
A. Gary and Diane Moseman (SP-04-16) requesting a special exception permit to renew a permit to continue mineral extraction.
Dave Lorenz, appeared and gave a brief history and background of the property, as well as reviewing photos and a video of the site. He then recommended conditions to be placed on the appeal if the request were approved.
White asked about the entrance photo. Lorenz explained.
Kettner asked if there are two entities on this site. Lorenz explained that the Mosemens owns the land but the Kraemers are the operators.
Kettner asked if there are any operations going on at the site at this time. Lorenz explained.
Kettner asked if the current operation being for an expansion but continuation as needed. Lorenz believes it is a continuation and explains the parcel is 20 acres in size and suggested the question on how much acreage to be disturbed is a question for the operator.
White asked about operating guidelines being covered in the new ordinance. Lorenz confirmed they are.
Ladas confirmed the request details. Lorenz explained.
Kettner asked about reclamation and when it would have to begin after quarrying has ceased.
Bob Jewell, Kraemer Co, applicant, appearing in favor of the request, stated they are seeking renewal of the 10 acre permit and it is adjacent to the Schuknekt property and they will operate the two properties as one site. He also confirmed the Town of Troy approved their request.
Kettner asked how long the life of the 10 acre site is. Jewell stated it is based on supply and demand so that is a difficult estimate to make, but it is a good source of aggregate.
Kettner asked about reclamation. Jewell confirmed that there is reclamation that has already taken place on the south side of the site. He also explained the reclamation process.
White asked about screening. Jewell stated that it is screened pretty well and you can’t see it from County Rd C, and feels it is very well screened.
White asked about the road use. Jewell stated they will continue to use the main entrance with the orange gate and the other road is just to be used to get equipment to the site.
Seeing as no one else wished to appear, Chair White closed the public portion of the meeting at approximately 9:28 am.
Netzinger spoke of using the 2006 decision letter and using those conditions, except for the 10 years.
Motion by Netzinger, seconded by , to approve the special exception permit to renew the permit to continue mineral extraction, with the conditions from Conservation, Planning and Zoning, using the conditions from the 2006 permit, excluding the 10 year timeframe. Motion carried 5-0.
B. Gilbert and Jean Burmester (SP-05-16) requesting a special exception permit to renew a permit to continue mineral extraction.

Kettner asked if there have been complaints on this site. Lorenz stated there are not.
Kettner asked how far this site is from White Mound County Park. Lorenz stated it is at least a couple miles.
Ladas asked about the request asking to combine this request with another request. Lorenz explained.
White asked about the 2nd Burmester property and when it expires, as well as the operation of the legal non-conforming property. Lorenz explained.
Bob Jewell, Kraemer Co, applicant, appearing in favor of the request, explained the site(s), the reclamation plan, and operating under the hours of the original permit, and there were 2 special exception permits and would like to combine them into 1 permit.
Netzinger asked if they have been to the Town of Franklin. Jewell explained that he has been to the Town of Franklin and Joe Prem has signed a Town Acknowledgement form.
Seeing as no one else wished to appear, Chair White closed the public portion of the meeting at approximately 9:45 am.
Motion by White, seconded by Kettner, to approve the special exception permit to renew the permit to continue mineral extraction, with the conditions from SP-17-06 and Conservation, Planning and Zoning. Motion carried 5-0.
Motion to adjourn by Allen, seconded by Netzinger. Motion carried, 5-0.
