This meeting is open to the public. However, in light of the COVID-19 pandemic, members of the public may wish to watch the meeting on streaming video which can be found on the County’s webpage at https://www.co.sauk.wi.us/meetings. No one should attend the meeting if they are experiencing COVID- or flu-like symptoms, have a fever, sore throat or recently experienced a loss of taste or smell.

5. APPEALS:
A. Petition 14-2021. Granting of a special exception permit pursuant to s. 7.036(5)(i) to authorize the operation of a lodging house. This property is located on real estate described as: E11604A Park Road, Section 14, T11N, R6E, Town of Baraboo, as further described in Petition 14-2021. Tax parcel 002-0393-00000, owned by Devils Lake Crossing LLC.This hearing is for the purpose of Board discussion and a decision on the appeal after receiving information from the Town of Baraboo, per the motion made on October 28, 2021.
B. Petition 01-2022. A petition to consider a special exception permit pursuant to s. 7.038(1)(i) of the Sauk County Zoning Ordinance to authorize the continued operation of a non-metallic mining site, one acre or greater and a Non-Metallic Mining Reclamation Permit pursuant to s. 24.05 of the Sauk County Non-Metallic Mining Reclamation Ordinance. The hearing is a combined hearing on the special exception permit and reclamation plan. The non-metallic mining operation is located in part of the SW¼ of the NW¼ and part of the NW ¼ of the SW ¼, Section 9, Township 13 North, Range 03 East, including parcels 024-0211-00000 and 024-0217-00000, Town of La Valle, Sauk County, WI.

At 9:09 a.m., Vice Chair Peper called to order the session of the Sauk County Board of Adjustment. Staff certified that the legally required notices were posted for the scheduled public hearings. Motion by Allen, second by Phephles to accept the certification for the public hearings. Motion passed 4-0.
Motion by Allen, second by Phephles to adopt the agenda. Motion carried, 4-0
Motion by Meier second by Allen to adopt the minutes from the December 29, 2021 meeting. Motion carried, 4-0.
Communications: None.
APPEALS:
A. Petition 14-2021. Granting of a special exception permit pursuant to s. 7.036(5)(i) to authorize the operation of a lodging house. Simmert appeared and provided an update/status on the appeal and notified the Board that the Town is present.
Mike Terry, Town of Baraboo, appearing as interest may appear, stated that the applicant has not completed the items required, since the last meeting, nor have they had any communication with the board. The Town of Baraboo request that the Board of Adjustment deny the request.
The Board went into deliberation, discussed the information heard during the public hearing and the request from the Town.
Motion by Meier, seconded by Allen to deny SP-14-21 for a special exception permit to authorize the operation of a lodging house, based on the finding of fact and conclusion of law, and failure to follow through with Town requirements per the October meeting. Motion carried, 4-0.

Christensen appeared and provided the staff report and analysis of the request. Christensen concluded with the staff recommendation and conditions to be included, should the Board choose to approve the request.
Mark Zobel, applicant, appearing in favor of the request, stated he would answer any questions the Board had.
Peper asked about the timeline, yardage, and material at this site. Zobel explained.
Seeing as no one else wished to speak, Vice Chair Peper closed the public portion of the hearing at approximately 9:32 a.m., and the Board went into deliberation.
Board members all agreed that the site has been successfully operated in the past and the applicant has provided a complete application meeting standards and requirements.
Motion by Phephles, seconded by Allen to approve a special exception permit for the continued operation of a non-metallic mining site, one acre or greater and a non-metallic mining reclamation plan, with the recommended conditions. Motion carried, 4-0.
6. Next meeting date – Thursday, February 24, 2022.
7. Motion by Allen, seconded to by Meier to adjourn at 9:35 a.m. Motion passed, 4-0.
