This meeting is open to the public. However, in light of the COVID-19 pandemic, members of the public may wish to watch the meeting on streaming video which can be found on the County’s webpage at https://www.co.sauk.wi.us/meetings. No one should attend the meeting if they are experiencing COVID- or flu-like symptoms, have a fever, sore throat or recently experienced a loss of taste or smell.

a. Petition 13-2021. A petition to consider application for a Special Exception Permit pursuant to s. 7.038(1)(i) of the Sauk County Zoning Ordinance to authorize the continued operation of a non-metallic mining site, one acre or greater and a Non-Metallic Mining Reclamation Permit pursuant to s. 24.05 of the Sauk County Non-Metallic Mining Reclamation Ordinance. A combined hearing on the special exception permit and reclamation plan will be held. Special exception request is located in part of the SE¼ of the NW¼, NE¼ ,SW ¼ and SW¼ all in Section 28, Township 12 North, Range 05 East, including parcels 010-1026-00000, 010-1011-00000 and 010-1013-00000, Town of Excelsior, Sauk County, WI. Reclamation activities include previous description, as well as parcel 176-0099-00000, Village of Rock Springs, WI.

At 9:07 a.m., Vice Chair Peper called to order the session of the Sauk County Board of Adjustment in the absence of Chair White. Staff certified that the legally required notices were posted for the scheduled public hearings. Motion by Allen, second by Meier to accept the certification for the public hearings. Motion passed 4-0.
Motion by Allen, second by Meier to adopt the agenda. Motion carried, 4-0.
Motion by Meier, second by Allen to adopt the minutes from the August 26, 2021 meeting. Motion passed, 4-0.
Communications: None.
Appeals:
Vice Chair Peper introduced the members of the Board and explained the procedures for the day.

Templin appeared and provided the staff report and analysis of the request.
Bob Jewel, representing Milestone Quarry, states they agree with the Land Resource Environment Department ordinance and was here in favor of the Special Exception Permit to continue operation of a non-metallic mining site. Jewel stated he was here to answer any questions. Jewel stated it is a very quiet operation. They have a generator that is in a trailer that powers most of the equipment except the loaders. Meier asked if they have a private driveway from Hwy. 136. Jewel explained it does have a private drive. Jewel stated the quarry is very low in dust since they use water to hold down dust. Peper asked what kind of material comes out of the quarry. Jewel explained.
John Traxler, Andy Edluwd and Doug Bettinger all appearing in favor.
Laurie Hasenbalg, S4190 Ableman Rd. Rock Springs, Wi 53961, appeared as interest may appear. Hasenbalg stated that LRE and Milestone have done a good job following the ordinance but has some concerns in regard to some missing information that is not on application. Hasenbalg stated that if there were ever any concerns with Milestone they were there to take care of it. Peper asked Hasenbalg if her #1 concern was the missing information on the application. Hasenblag stated yes. Boda asked if the information existed. Peper questioned the Seis Mograph measures from any of the blast. Hasenblag stated that she was not sure but stated Jewel would be able to answer. Peper asked if there was ever any damage to her house from any blast. Hasenblag stated she has never had any damage to her home. Peper asked how far her house was from the quarry. Hasenbalg stated about ½ mile.
Templin came forward and stated that all the missing information is in the reclamation packet. Templin stated the hours of operation and noted the transportation routes were also being followed according to the ordinance.
Jewel came forward to answer questions. Peper asked Jewel how many truck loads come out of the quarry in one day. Jewel stated around 100 loads. Peper asked what an acceptable vibration from the seismograph would be. Jewel explained.
Peper asked if there was anyone else who wished to speak. Peper closed the public portion of the hearing and the Board went into deliberation at 10:02 a.m.
Motion by Allen, second by Boda to approve a Special Exception Permit to authorize the continued operation of a non-metallic mining site, one acre or greater and a Non-Metallic Mining Reclamation permit based upon the Findings of Fact and Conclusion, and subject to LRE staff conditions. Motion carried 4-0.
Next meeting date – Thursday October 28, 2021
Motion by Allen to adjourn, second by Meier. Motion passed, 4-0. Meeting adjourned at 10:07 a.m.
