MEETING NOTICE/AGENDA

This meeting is open to the public. However, in light of the COVID-19 pandemic, members of the public may wish to watch the meeting on streaming video which can be found on the County’s webpage at https://www.co.sauk.wi.us/meetings. No one should attend the meeting if they are experiencing COVID- or flu-like symptoms, have a fever, sore throat or recently experienced a loss of taste or smell.

This property is located on real estate described as: E11604A Park Road, Section 14, T11N, R6E, Town of Baraboo, tax parcel 002-0393-00000, owned by Devils Lake Crossing LLC.

At 9:00 a.m., Chair White called to order the session of the Sauk County Board of Adjustment. Staff certified that the legally required notices were posted for the scheduled public hearings. Motion by Phephles, second by Peper to accept the certification for the public hearings. Motion passed 5-0.
Motion by Allen, second by Peper to adopt the agenda. Motion carried, 5-0
Motion by Peper, second by Phephles to adopt the minutes from the September 30, 2021 meeting. Motion passed, 4-0 with White abstaining.
Communications: None.
Discussion and possible action on change of meeting date in December. Motion by White, second by Peper to change to December meeting to December 29, 2021 due to the building being closed for the holiday on December 30, 2021. Motion passed, 5-0.
Appeals:
Chair White introduced the members of the Board and explained the procedures for the day.
a. Petition 14-2021. Granting of a special exception permit pursuant to s. 7.036(5)(i) to authorize the operation of a lodging house. This property is located on real estate described as: E11604A Park Road, Section 14, T11N, R6E, Town of Baraboo, tax parcel 002-0393-00000, owned by Devils Lake Crossing LLC.
Hillmann appeared and provided the staff report and analysis of the request. White asked how many properties were within 500 feet of the proposal. Hillmann explained. White asked if the residents in the area were notified of this request. Hillman explained they were. Peper stated that we should wait for the Town’s approval.
Neil Mattson, applicant, appearing in favor, gave the background of the property. Mattson is aware of the need to postpone action until all UDC inspections are complete and other requirements by the Town of Baraboo are met which includes completion of a Town Acknowledgement, local town public hearing, and action/recommendation by the Town of Baraboo Plan Commission and Town Board to the Board of Adjustment.
Mike Terry, Supervisor for the Town of Baraboo, appearing as interesting may appear. Terry recommended postponing the decision until town requirements are met and the town has had an opportunity to consider the proposal.
White asked if there was anyone wish to speak. Chair White closed the public portion of the hearing and the Board went into deliberation at 9:14 a.m.
Gina Templin-Steward, LRE, appeared and recommended should the BOA chose to postpone a decision, it be to a date certain. This date should provide the town enough time for all inspections to take place and the town meeting requirements to be held. Phephles asked if it would have to be a public notice again. Templin explained noticing requirements. LRE staff suggested the decision be postponed until at least the January Board of Adjustment, but to confirm with the Town of Baraboo as to their preference.
Mike Terry, reappearing, verified that the Town would agree that the decision be postponed until at least the January hearing.
Motion by Peper, second by Phephles to postpone the Special Exception permit request until the January 27, 2022 Board of Adjustments meeting. Motion passed 5-0.
Next meeting date – Thursday, November 18, 2021
Motion by Allen to adjourn, second by Phephles. Motion passed, 5-0. Meeting adjourned at 9:27 a.m.
