Electronic Real Estate Transfer Return (eRETR) now required for ALL conveyances, regardless of exemption.

     2015 Wisconsin Act 145, signed into law by Governor Walker on February 4th, 2016, will require an electronic real estate transfer return (eRETR) with all conveyance documents.  There is one exception to this requirement and that is for conveyances executed prior to October 1st, 1969,  s.77.25(1).  This act applies to conveyances beginning February 6th, 2016.

     Effective that date, all deeds must be accompanied by a receipt from eRETR.  This includes conveyances that are exempt by (2), (2r), (4) or (11).  Please keep in mind that an eRETR receipt is also required with the TOD-110 (transfer to beneficiary) and ANY affidavit that corrects a deed or land contract, regardless of type of error.  This includes any deeds that amend items such as grantor/grantee name, establish a name change (ex: Grantee marries) or change the vesting portion of the instrument (ex.  Joint to HWSMP)
