Sauk County Planning, Zoning and Land Records Committee Meeting
March 9, 2010
Committee Members Present: Ashford, Gaalswyk, Netzinger, Lehman and Blakeslee.
Others Present: Mark Steward, Brian Simmert, Junior Gurgel, Lowell Haugen, Steve Pate, and Brent Bailey.
Chairman Lehman called the meeting to order at 9:00 and compliance with open meetings law was certified.
Motion by Gaalswyk, seconded by Ashford to adopt the agenda as presented. Motion carried, 5-0. It was noted that the agenda had not been posted on the website as of Sunday evening.
Motion by Gaalswyk, seconded by Blakeslee to approve the minutes of the February 23, 2010 Committee meeting. Motion carried, 5-0.
Public Comment: Junior Gurgel from the Town of Excelsior requested to address the Committee. He wanted to know the procedure to get the County to move ahead with adding a new district of RC2 to the ordinance. The Zoning Ordinance is now in the process of being rewritten. There is currently a lot of disagreement in the town regarding this new district. He was told that the town could petition the committee the same as a rezone request.
Communications: Steward called attention to the communications that had been sent to members in their packets. He had a new response to Tyson Hall from Assistant Corp. Counsel Chad Brown. Malave was briefly discussed, he took his situation to the press. The Brian Farr violation was reviewed. Signs were briefly discussed.
Steve Pate, Mapping Department, appeared and gave his monthly report. Statistical information was reviewed. Vouchers were reviewed in the amount of $3,340.22. Motion by Gaalswyk, seconded by Blakeslee to approve the Mapping Department's vouchers. Motion carried, 5-0.
Brent Bailey appeared for the Register of Deeds office. He gave his monthly report. Scanning plats was discussed. He will be watching the flat fee development. Register of Deeds' vouchers were reviewed in the amount of $3,162.12. Motion by Gaalswyk, seconded by Ashford to approve the vouchers. Motion carried, 5-0.
Mark Steward, Planning and Zoning Director, appeared. He briefly reviewed the Department's Annual Report. Financial accounts were reviewed. Baraboo Range Protection Program's annual Report was discussed.
The next item for discussion was dividing the Ron and Sue Goette property. Steward gave the background on the property as far as being covered by a conservation easement. The DNR currently wants to purchase a part of the property. The property was offered to the DNR first and they didn't have the funding at that time. Another property owner wanted to divide their property in the Baraboo Range and they were not allowed to do it. How could this be allowed now? The Committee had numerous questions on this matter. Who approached who with regards to the offer? Is the DNR going to pursue all the other properties on Herwig Road which will mean the owners will be paid twice for the land. Should the owner have to return the development rights purchase money? At what price was the DNR willing to pay for the property? If the entire parcel was being purchased, there would not be a problem. Does the acreage left meet the ordinance regulation? The Conservation easement does not allow for the division of the property. The Committee needed answers to their questions and decided to postpone a decision indefinitely.
Brian Simmert appeared next and gave the background on a proposed conditional use permit for the Estate of Helen Meyer. Farm consolidations will be discontinued after this year. The conditional use permit standard was read and answered affirmative, 5-0. Motion by Ashford, seconded by Blakeslee to approve the request. Motion carried, 5-0.
The proposed conversion fee and SB576 were reviewed. Who will need to pay the fee was discussed. The Committee decided to delay taking it to the County Board until they see what the State is going to do.
The next meeting is scheduled for March 30, 2010 at 5:00 P.M.
Motion by Gaalswyk, seconded by Netzinger to adjourn. Motion carried, 5-0.
