Chairperson Krueger called the meeting to order at 8:00 A.M. and noted compliance with the Open Meeting Law.
Motion by Endres, seconded by Wenzel to approve the agenda, as amended.
Motion carried.
Motion by Fordham, seconded by Wenzel to approve the minutes of the January 5, 2010 meeting, as mailed.
Motion carried.
None.
Chair Krueger distributed copies of the following: A letter from Chair of the Western Technical College District Board Appointment Committee concerning appointments to be made to the Western Technical College District Board, effective July 1, 2010 and a copy resolution from Rock County Board of Supervisors requesting a state law change allowing counties the use of the design-build construction method.
B. Mielke, County Clerk, presented the monthly report and list of bills for her department. Motion by Wenzel, seconded by Endres to receive the report and approve vouchers in the amount of $23,995.39. Motion carried.
S. Pate, MIS Director, presented the monthly report and list of bills for his department. Motion by Endres, seconded by Fordham to receive the report and approve the vouchers in the amount of $43,099.01(2009) and $80,995.54(2010). Motion carried.
Pate distributed copies of the draft Sauk County Website Publication Policy for review. Motion by Wenzel, seconded by Fordham to approve the policy. Motion carried.
A. Kleczek, Acting Corporation Counsel, presented the monthly report and list of bills for her department. Motion by Endres, seconded by Stevens to receive the report and approve vouchers in the amount of $486.94(2009) and $256.47(2010). Motion carried.
Motion by Stevens, seconded by Wenzel to go into closed session pursuant to Wisconsin Statutes, Section 19.85(1)(g) for the purpose of conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved: Evelyn Propp v. Sauk County Board of Adjustment, 2007 CV 524 and allow the following individuals to remain: K. Schauf, A. Kleczek, B. Mielke, and M. Steward. Roll call vote was taken on the motion with the following results: AYE: (5) Krueger, Stevens, Endres, Wenzel, and Fordham. The Committee went into closed session at 8:45 A.M. and returned to open session at 9:25 A.M.
A. Kleczek distributed and discussed draft copies of an Indemnification and Hold Harmless Agreement between Sauk County and the Town of Spring Green regarding the economic development grant for construction of a drainage facility. It was the desire of Committee members to have the Town adopt the agreement prior to the County; Kleczek was instructed to continue to work with the Town's attorney and keep the E&L Committee informed of any significant developments.
Kleczek updated Committee members on the history of this case and distributed a resolution denying the claim. Motion by Fordham, seconded by Wenzel to recommend forwarding the resolution to the County Board for consideration at the February 17, 2010 meeting. Motion carried.
K. Schauf, Administrative Coordinator, presented the monthly report and list of bills for her department. Motion by Stevens, seconded by Fordham to receive the report and approve vouchers in the amount of $4,087.71. Motion carried.
Chair Krueger presented his monthly report, noting the following: issues related to the Sauk County Health Care Center Benefit Club, meeting and release of the Merrimac Bridge Study, and status of the EDA Grant.
The resolution was distributed for review, followed with a motion by Fordham, seconded by Stevens to forward the resolution to the County Board for consideration at the March 16, 2010 meeting. Motion carried.
Committee members agreed it would be appropriate to forward a resolution to the County Board at the April, 2010 meeting commemorating National County Government Month.
Supervisor Stevens reported the Drainage Board has held no meeting since the last E&L meeting, however, he noted receipt of a letter from James Evenson, Circuit Judge, Branch 2, indicating the term of Jeff Sprecher as a member of the Sauk County Drainage Board will expire on March 4, 2010. The Acting Corporation Counsel will follow up on procedure and recommendations.
Draft copies of the resolution were distributed and discussed followed with a motion by Endres, seconded by Stevens to recommend forwarding the resolution to the County Board for consideration at the February 17, 2010 meeting. Motion carried.
Kleczek reviewed proposed changes to be made in the Rules of the Board which were already discussed and other issues that can be addressed. Due to the amount of time required to give this matter thorough consideration, the Committee agreed to schedule a special meeting to be held on Wednesday evening, March 3, 2010 at 6:00 P.M. to consider Rules of the Board and 2011 budget development, strategic planning and program prioritization. The next, regular E&L meeting date was set for Tuesday, March 2, 2010 at 8:00 A.M.
Motion by Stevens, seconded by Endres to go into closed session pursuant to Wisconsin Statutes, Section 19.85(1)(c) for the purpose of considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility: Performance evaluation of Acting Corporation Counsel and allow the following to remain: A. Kleczek. Roll call vote was taken on the motion with the following results: AYE: (5) Krueger, Stevens, Fordham, Wenzel, and Endres. The Committee went into closed session at 11:05 A.M. At 12:10 A.M. the Committee returned to open session followed with a motion by Wenzel, seconded by Stevens to adjourn. Motion carried.
