Committee Members Present: Cassity, Ashford, Gaalswyk, Netzinger, and Lehman.

Others Present: Mark Steward, Mary White, Steve Sorenson, Dave Tremble, Marty Krueger, Richard Schlough, Bob Jewell and Richard Marino.

Meeting called to order by Chairman Cassity at 9:00 A.M.

Staff certified compliance with open meetings law.

Motion by Gaalswyk, seconded by Lehman to adopt the agenda. Motion carried, 5-0.

Motion by Gaalswyk, seconded by Ashford to approve the minutes of May 12, 2009 as presented. Motion carried, 5-0.

Public Comment: Steward introduced Kevin Hite the GIS intern.

Communications: Steward requested Committee members interested in attending a meeting on "Energy Independent Communities" contact him. He also referred to an e-mail received from Jim Birkemeier regarding sawmills.

Planning and Zoning vouchers were reviewed. Motion by Ashford, seconded by Cassity to approve the vouchers in the amount of $52,248.96. Motion carried, 5-0.

The Committee then discussed Chapter 7 regarding signs and the Pam Leonard situation. Netzinger requested that the language be cleaned up. This would need to go to a public hearing. Netzinger requested different wording for specific sections. Steward was requested to put specific wording together and bring it back to the Committee for their next meeting. Uniformity outside municipalities and extraterritorial zoning was discussed. There was some confusion on the Pam Leonard sign whether the sign was within road setbacks or the road right-of-way. Steward responded that she was 4 feet within the road right-of-way. Removal of the sign was only one of several options given to her.

The Committee then discussed Board of Adjustment nominees. They are Benny Stenner, David Allen, Tim McCumber, Fred Collar, and Don Toeder. Discussion followed. Motion by Ashford, seconded by Lehman to forward all five names and the paperwork to the Board Chair for his review. Rules of the board were discussed. Motion carried, 5-0.

Discussion followed regarding the Baraboo Range Protection Program and Commission. Marty Krueger appeared. The major work of the Commission has been done and could possibly be phased out in the future. The Commission will be meeting tomorrow morning. The Commission still has a say regarding oversite and duties of the County. He said he could see the Commission staying together for another year, meeting every 6 months to complete the oversite project. He requested that no action be taken on this subject at this time. Motion by Netzinger, seconded by Gaalswyk to postpone any action on the Baraboo Range Protection Program and Commission. Motion carried, 5-0.

Public hearing was called to order by Chairman Cassity at 9:40.

The Chair gave the order of the hearing and the Committee introduced themselves. The notice was read.

The first item to be heard was a petition to rezone certain lands in the Town of Franklin, County of Sauk, Wisconsin, from an Exclusive Agriculture to an Agriculture Zoning District. Lands are owned by Gilbert & Jean Burmester. Lands to be affected by the proposed rezone include a parcel of land located in the N ½ of NW ¼ of SW ¼ Section 6, T10N, R3E, Town of Franklin, Sauk County, Wisconsin. Area to be rezoned contains 20.00 acres more or less.

Brian Simmert appeared, explained the request and background of the Jackson Quarry.

Richard Morino, representing the Kraemer Company, appeared in favor. The property to the west is owned by Burmester and was rezoned 5 years ago. This was just an expansion of the existing quarry. They will have to go to the Board of Adjustment for a permit. Reclamation has been done on the eastern side. Seeding is an on going process.

Bob Jewell, also with the Kraemer Company, appeared in favor. Mining will continue to the north with a buffer of trees so the quarry cannot be seen from Highway 23. He gave the quarry depth as 60 feet. The township doesn't want spot zoning. Boa decision will have conditions on it. A stated approved high capacity well was installed to wash aggregates. Local wells will be protected.

Seeing there was no one else wishing to speak, the public portion of the hearing was closed at 10:03.

Gaalswyk stated the quarry has been there for 50 years and can't be seen from the road and hasn't created any problems with the town. Motion by Gaalswyk, seconded by Netzinger to approve the rezone request from Exclusive Ag. To an Agricultural District. Motion carried, 5-0.

The next petition to be heard was a petition to rezone certain lands in the Town of Woodland, County of Sauk, Wisconsin, from Agriculture to Recreational - Commercial Zoning District. Lands owned by Plum Valley Investments, LLC c/o Richard Schlough. Lands to be affected by the proposed rezone include a parcel of land located in Section 6, T13N, R2E, Town of Woodland, Sauk County, Wisconsin. Area to be rezoned contains 5.00 acres more or less.

Simmert appeared and distributed a plat of survey for the property. He gave a brief history on parcels and its current use. He explained that the owner had reconsidered and that there would be no sale of alcohol on the property. He stated that the Town of Woodland Comprehensive Plan did not permit a rezone to recreational-commercial. The Plan needs to be changed. Simmert recommended postponing a decision until after the town had voted on it. A recommendation to change Woodland's plan will be discussed on July 13, at their town meeting. Simmert gave a time line as July 13th with the town, July 14th back to this committee and then on to the County Board followed by the Board of Adjustment. The owner has an event scheduled for the end of August.

Richard Schlough, representing Plum Valley Investments, appeared in favor. He stated that he knew he had to go to the Board of Adjustment also. He planned on 2 horse shows a year and camping with boarding for 15 horses. He owns 10 of his own horses. He stressed this is a family type of gathering. Food sale was reviewed. He stated that the Town supported his project.

The Committee noted that a similar rezone had been approved for a parcel in the Town of Reedsburg. Camping and food sales are what requires it to be zoned recreational commercial.

Manure storage and handling as well as rotational grazing was discussed. He also had his own 90 head of cattle on his land and land he rented. He had a nutrient management plan with land conservation in place. He stated that there were wetlands on the property and they were being protected. Boarded horses would not be pastured. He owned a total of 54 acres. He was proposing sanitation facilities for campers with showers and toilet buildings.

Seeing no one else wished to speak, the public portion of the hearing was closed at 10:35.

Motion by Lehman, seconded by Gaalswyk to postpone a decision on this matter until the July 14, 2009 meeting. Motion carried, 5-0.

Motion by Ashford, seconded by Gaalswyk to adjourn. Motion carried, 5-0.
