Land Conservation and the Planning and Zoning Committees

Meeting called to order by Chair Wiese at 9:07 a.m. It was certified that the requirements of the open meeting law have been met. Present were Lehman, Wiese, Borleske, Cassity, and Cummings from the Land Conservation Committee; Lehman, Ashford, Gaalswyck, Wiese, and Sprecher from the Planning, Zoning, and Land Records Committee; Van Berkel and Pohle-LCD; Gurney and Tremble-P&Z. Zowin was absent.

Adopt agenda: Motion by Borleske/Cassity to adopt the amended agenda.
Motion carried, all in favor.

Update on livestock siting rules: Van Berkel and Gurney updated the committees on the status of the proposed rules. The DATCP Board has approved the rules and sent them to the legislature. There is still considerable concern over the odor requirement among many farm organizations. The counties also have concerns because the rule overrides any local ordinances. The minimal setbacks are one area of county concern. The rule does require nutrient management planning, runoff evaluations, emergency action plans and worker training that would be beneficial practices. This would help us address some of the concerns people have with large operations. Van Berkel suggested it may be in the best interest of the county to adopt the rules even with the flaws to at least put these requirements in place. Without adoption there can be no standards required for livestock operations between 500 and 1,000 animal units in size.

Approving language amending the Sauk County Baraboo Range Protection Plan allowing Sauk County to utilize $250,000 of specially designated USH 12 MOA funding to purchase development rights to properties whose boundaries overlap the BRNNL or lie directly adjacent to and contiguous with lands in the BRNNL:

Cassity distributed information regarding the funds provided by Lombard. Tremble gave background on the source of funding. Amending this plan would provide a mechanism to use these available funds to protect agricultural land. Department of Transportation staff said the existing agreements, the Memorandum of Understanding (MOU) and Sauk County implementation agreement, are sufficient and no additional agreements would be necessary. Committee discussed this resolution and the relationship to the $200,000 previously budgeted by the county for the Agricultural Purchase of Development Rights.

Motion by Ashford/Gaalswyck to approve the resolution as printed.
Motion carried by Planning, Zoning & Land Records Committee, all in favor.

Motion by Borleske/Lehman to approve the resolution. Motion carried by the Land Conservation Committee, all in favor. Cassity commented he would like some more time to review the entire resolution before signing.

Implementation of stormwater runoff and construction site erosion control rules by local municipalities:

Gurney reported that they found 60%-70% compliance with erosion control requirements for the Uniform Dwelling Code (UDC). The noncompliant sites often had silt fabric fencing on site but it was not installed properly to meet the requirements. This indicates the need for better training on the installation of silt fences. Gurney pointed out that the Department of Commerce is increasing their emphasis to UDC inspectors to better monitor erosion control. The majority of the problems were found in rural small lot subdivisions and along shoreline. Staff made no recommendations at this point but will watch what Commerce does over the next year to achieve better compliance.

Progress on cluster development proposal:

The revised version of the Sauk County Zoning Ordinance to allow cluster developments was distributed. The original target to present the ordinance before the Land and Water Conservation Board (LWCB) was December 6 but Gurney requested to postpone it until February 7 to allow Corporation Counsel to review the changes. After approval by LWCB, both committees will need to approve the ordinance changes before forwarding it to the County Board.
